Yes. For two reasons. First of all you haven't mentioned what they should be able to sue them for. If they are given food poisoning from junk food then why shouldn't they be able to?
Secondly, on the issue of people becoming overweight from Mcdonalds, comparisons can be drawn with US tobacco litigation such as the Engle case in florida which resulted in $145bn punitive damages on the basis that Phillip Morris produced a dangerous and defective product. Although this award was overturned on appeal it does show that the courts are open to such a challenge and I can see no logical reason why the fast food industry should not be open to a similar challenge.
Yes I am well aware that people make their own choices and should have the right to choose but this does not negate the fact that any company selling a consumer product which will potentially kill its customers should be open to litigation. You cannot base the legality of a product upon the personal autonomy of its potential customers. |

Fast food is meant to be a convenience , for when you are out or don't have time to prepare your own . It is not meant to be the major part of your diet. If a person decides to do so then they have to bear responsibility for their actions.
That said ,They have a right to sue , I just don't think they should be awarded anything.
Next thing you know ,people will be suing for pouring hot coffee on themselves . |

no. I am an overweight person and I don't think we should be able to sue junk food companies for that. I mean it's for most of us our own fault that we got this way. I've actually been this way my whole life, but I dont blame it on the food companies they don't control what I eat. It's based on how you are taught to eat and how you let yourself eat all the bad stuff. You can eat junk food, but just not in large amounts. You just have to limit yourself to what you eat when it comes to eating junk. |

NO! the vendors do not MAKE the people buy and eat the product. They do that all on their own! It is kind of like suing the cigarette companies for smokers. they smoke for many years, then when they develop lung cancer, the family wants to blame the manufacturers - or the government for not closing down the factories! It should not be allowed on grounds of frivolousness! |

No, our litigious society needs to be checked. Make people resonsible for their own actions. Suits should only be brought in cases of gross negligence and deceptive practice.
And as for suing fat people for rising health costs, why not add smokers, drinkers, and people who multi-task while driving to the list. (Lots of sarcasm implied here.) |

Absolutely not. The problem with this country is a lack of accountability. Sure, fast food companies, junk food vendors, etc will do all they can to make their product look appetizing and irrestistable. We still have to ultimately be responsible for our own actions. |

well no i think thats just stupid but junk food vendors should have certain limits imposed on them. it's gotta be hard for very over weight people, junk food is so cheap when compared to healthy food that tastes horrible and its a hard cycle to break. |

No. This would be a frivilous lawsuit. The junk food vendor doesn't MAKE you go to the vending machine and get the Twinkies to eat that make you fat. Just like with cigarettes, people know they're bad, they know the consequences, so if they choose to indulge, it's their problem, not the fault of the cigarette company.
Unlike cigarettes, however, eating a Twinkie now and then isn't going to do much to you if you exercise and have a balanced diet otherwise. It's more about the individual than about the company.

In my personal opinion NO! Overweight Americans have the choice to eat healthy and monitor what goes in their mouth. I think blaming "junk food vendors" is just an excuse, so that individual doesn't have to "face the music" and acknowledge they are to blame for their weight issues. Junk food vendors are not the ones feeding us - we make those choices ourselves. If you know what the problem is (in this case fast food, junk food, etc) stop consuming them!! A change in diet and good exercise will help. I understand that it is difficult for overweight people to find motivation because they are, respectfully in many ways lazy, but it only takes the first step - that's the hardest. Everything gets easier after that initial step. Lets start taking the blame for our self instead of pointing fingers, because that isn't going to change - we have to!! |

No way! This makes about as much sense as the judge who tried suing the dry cleaners MILLIONS of dollars over one pair of pants. Whatever happened to realizing that **** happens, taking responsibility for your actions, and just being a decent citizen? Some folks are so greedy these days that they see a 'loophole' if things aren't spelled out from start to finish or if someone isn't holding their hand the whole way.
Sue them though, if they come to your house and traumatize you in anyway. I'd say that's your right. |

Free choice has factored in to every court decision regarding bad choices by consumers, the court has ruled consistantly that given choices people are free to make good or bad, and thus the purveyor of the goods is not liable for the results if they are following govt. guidelines already in place (listing contents, calories, etc.) |

No they shouldn't. Most people are aware that "junk food" or fast food is bad for them, yet they choose to eat it knowing the potential health risks involved.
More to the point, eating fast food and junk food alone don't contribute to being overweight. Other factors include heredity (does being overweight run in the family), other health issues and how often one exercises and what else they eat.
They sue these companies because they have deep pockets, and their easy targets. Moreover, perhaps psychologically they feel bad or are embarrassed about their weight, but if they can blame someone else instead of taking personal responsibility for themselves then somehow it's not their fault and it's okay. Either way its B.S. and they should have no legal grounds for a lawsuit. |
