The short answer is: due process. A person cannot be held criminally or civilly liable for acts of others. If child A destroys property, parent B is not liable for that damage and parent B cannot be sent to jail due to child A's actions. It is all about personal responsibility. Although a parent might fail to raise the child in an optimal manner, it is still the child who chooses whether or not to break the law, and therefore the child who is responsible.
Most people think that when a child does something wrong, such as destruction of property, then the parents are held liable and must pay for the damages. In fact, that isn't legally true. The child is legally responsible and can be sued by the victim. If the victim wins, however, the child doesn't have to pay the damages award until she/he becomes an adult. At that time the victim can seek the damages awarded earlier. If the damages award was small, the victim probably won't want to go through the trouble of having a lawyer track down the child-adult, and the fact that the victim might have to wait years and years to collect also makes the chances of collecting less likely. If the parents want to pay off the damages for the child, they can choose to do so but they are not legally required to do so. |

There is only so much a parent can do to teach their children the rights and wrongs of life. Hopefully the parents gets through to the kid so the kid will understand. You can't hold a parent responsible for a kids action I don't believe. A child has it's own mind regardless. Kids like to explore and they like to test themselves and their parents. A parent and a child are two different people. That kid most likely made the choice and even thought about it before they did something wrong. You can't blame a parent for what a kid was thinking sometimes no matter how you raised the child. |
