Maybe if they paid station attendant's more $$$ they would actually care |

No. It is illegal in the United States to deduct the cost of doing business from an employee's pay check. |

I don't think so. Seems a bit underhanded to me. |

I don;'t think that is legal, but I'm not legally trained. |

I work at a petrol station we have drive off and we dont have to pay, tell your boss to get better cctv that way he will always get the number plate or get a new job |

I don't know, but I wouldn't work there anymore.
Just write down "In Transit." Or make everyone prepay. |

I worked for 4 petrol companies over a 20 year period and some companies "tried this on",I believe it to be illegal, but there were staff who would lie about drive offs and pocket the cash.I never worked for any company that was willing to pay out for adequate CCTV which would of course make things easier on everyone.
Don't let them touch your wage! |

No. I think would fall under in case of a robbery you don't get your wages deducted from what the criminal took.
I think you do have a case here. |
|

Blunt Honesty

Not in Texas. It is never legal to deduct anything from a paycheck without the employee's written approval. You can fire someone for not doing their job, but you can't deduct wages. |
|

?

Yes its illegal, |

I don't think so, but check with you state's dept of labor. They can tell you. |

I'm not in the position to say if this is legal or not but if so, where will it end?...If a waitress doesn't get the i.d. of a customer who left without paying? If a grocery checker doesn't stop a shop lifter? If a factory worker doesn't report a co-worker for company theft? Which kid in the classroom will be held liable when another kid steals the teachers purse!? |

I don't think they should, however, if the attendant has turned the pump on, they take the responsibility that the vehicle has a clear index plate showing, that the person filling it up is aged 18 or over and that they are putting the fuel in a correct container. they should also be sure that the index can be seen on CCTV. I have had attendants phone the police and say they have had a drive off, didn't know what car it was, didn't know what the driver looked like, so they mist take some responsibility, and they are paid a fair wage, in the UK it is above the minimum wage |

Unless the owners are OK with me standing out there with a shotgun to prevent it from happening. Run that by them. |

I would imagine it is borderline. They need legal representation. |

No...it's out of their control...unless you can prove they allowed the drive off.
Besides confronting someone can be deadly.
Why not take responsibility and change your system to pay first. |

That is not morally right to do, and does not sound legally right either. |

Gut answer would be no staff shouldn't pay for drive off's.
Thats what CCTV is there for |

HELL NO! If your boss makes you pay for a drive-off then you need to kick his azz! It's not the employee's fault that someone steals gas. What are you supposed to do? Stand outside with a baseball bat to make sure the customer pays?? lol
Tell your boss to piss off, and go find another job if he makes you pay for a drive off.
P.S. NO, it's NOT LEGAL to make you pay for a drive off. Your boss can NOT enforce that rule! Don't sign anything saying that you agree to that rule! |

I know plenty of waitresses and grocery store clerks who had to make up for shortfalls in their cash drawer at the end of a shift. How many drive offs has this employee had? Do we get more drive offs on his shift than others? Could he be getting him and his buddies free gas and then calling in a "drive off"? I think the boss is trying to get the employees to be more vigilant. |

Legal or not it is a mean practice. If the employer is too tight to get cctv then dont work for him.
What happens when someone walks in with a gun and takes all the money?
My own view is that stealing is wrong. If any shop/supermarket/whatever make it easy to steal then its the owners problem not mine. He takes the risk, not me.
I will not use certain supermarkets because of their security systems. They presume guilt.....and I do not accept. |

not in Minnesota. your job is to write down plate numbers. you can be fired for incompetence but it is probably illegal in your state to take it out of your check. |

I have worked in 3 different gas stations/convenience stores and only one of them actually took money from the employees check when a drive-off occurred. The other 2 just wanted us to make sure we got vehicle make, color, license plate, time, and amount and to file a police report.
I don't know whether it is legal or not, but I do know of some stations that have that policy. I wouldn't work for someone who actually took drive-off money out of my check! |
|

I wouldn't think that's legal. That's just taking away money from innocent people. |

No, and where any employer takes any money other than tax and NI, it is deemed as theft. |

I don't know what a 'drive-off' is! Sorry. |

I think its totally wrong but obviously companies write there own rules most of the time, if it is written in the employee contract....
You think how much profit the companies make compared to wages out its morally wrong |
|

Staff should not be responsible for drive-offs. It should be the responsibility of the business owner to have adequate camera coverage to record licence plate numbers. |
|

sandyblondegirl
 |
I do not believe it's legal, or ethical, to do this.
Contact your state's Department of Labor, there may have an 800 number for this. They will contact your employer telling them to stop this practice. |

Well if it isn't illegal, it sure isn't nice!! |

I assume that you are referring to a gas station. If that is the case, no. There should be a pay before you pump policy. Especially with gas prices being as high as they are. That is what they have done in my town. |

I work for a petrol station and had a drive off last week for 93.00 I got the reg, make, model, colour, description of person duelling etc etc and I am still being made to pay back the 93.00 |
