Should this guy be charged with anything more than DUI?
Find answers to your legal question.

Should this guy be charged with anything more than DUI?

Let's say a guy was driving down the road drunk. Then all of a sudden a car runs a red light in front of him and he t-bones the car, killing the passenger in the other car instantly. The other car is a fault but this guy is also drunk but had no time to brake, slow down or swerve. Do you think he should be charged with anything more than driving under the influence?

No....they are both at fault for the accident.
Alright maybe just maybe first guys driving abilities were impaired but how much? I think limits are .08 blood alcohol....PLEASE! Why not decide on how well he scored on his drivers exam or his vision his IQ, does he have arthritis is one leg shorter than the other was he tired or upset.

Bad things happen everyday to good people it's a shame but we need to stop asking the government to protect us from every single sort of harm, it's choking this country. You don't want die in a car crash don't drive.

No, the other guy ran the light, so his death was his own fault. Chances are the DUI guy couldn't have avoided hitting him even if he had been sober. I have no sympathy for DUI drivers, but the guy ran a light. I was t boned by a sober person running a light, all I broke was a finger.

Anyone that gets behind the wheel of a car has a responsibility to himself and others on the road. If he had not been under the influence of alcohol, he might have been able to slow down or swerve out of the way before the impact. But that is a huge hypothetical.

Vehicular homicide, or involuntary homicide.

I'm glad that I'm not a judge.

Vehicular homicide.

You are to be in control of your car at all times

Should he be? Maybe not. Will he be? Definitely.

Evil Resident
no he should be charged with the crime that he committed

if i let someone stay the night in my guest bedroom and we get drunk that night my guest hangs himself then am i at fault. this is pretty much the same thing only without the cars

Sanjay
if someone has an illegal level of alcohol and is involved in a fatal accident, there's a very high chance of getting charged with manslaughter, even if the very same accident without their having alcohol would leave only the other guy charged

that's just the way it is - dui is very political

If you're driving under the influence of alcohol or any other substance your perception and reflexes are going to be down. If the driver was drunk he should be charged with DUI and manslaughter. If you get in a car while under the influence you're breaking the law before you leave the dooryard. In fact, most states can charge you with attempting to operate if you're under the influence and getting into a car with the intention of operating. It's not often anyone wins a case in court by saying, yes I was drunk but it was the other guys fault :)

Manslaughter charges might apply.

No one should ever drive drunk, it's an incredibly irresponsible and dangerous thing to do, just like running a red light. If you don't want to die in a horrible accident don't run red lights!

Clem
He killed somebody because he was behind the wheel drunk. If he hadn't been drunk his ability to avoid the accident would have been a lot more likely. He should be charged with intoxicated vehicular homicide.
