Should the United States establish a legal prescient to justify the use of torture ? Should confessions that come through the use of torture be considered credible in a court of law ?

I hope you mean precedent.
The US (as in Legislature) does not set precedent, courts do, that is the common law, or at least the system of common law.
The confessions that come through torture should not be considered credible, because at least 50% of the time they are not, a person who is tortured will tell you anything you want to hear so as not to be tortured anymore. |

It's a fact: under torture you can confess to ANYTHING even if you are innocent and know nothing about the crime you are being accusedd of.
Now imagine you are accused of rape by a psycho ex-girlfriend, just your word against hers, so :
Would you allow the cops to rip off your 20 nails just to prove you are innocent????
I serioulsy doub it becuase I'm sure you would sign any confession after the second nail. |

There is no legal precedent that should affect non-US citizens. For example, Al-Qaeda members should not be protected by our legal system. While I believe excessive pain-inducing techniques are ineffectual at best, techniques such as waterboarding and sleep deprivation should be acceptable, seeing as the information it could (and has) generate can be useful in the protection of our country. |
