I think there should be a point in a child's life that's "open to interpretation".

Some thirteen year olds I know are very mature in their thinking, and some seventeen year olds I know are almost as children. I think it would be a good idea if a psychiatric board were established for children 12-17 to establish their mental state, and should be tried as an adult, or child, based on that.

Well it depends on the crime. If they take a pistol to school and kill 13 people, yes they should stand trial as an adult. If they are adult enough to decide that those people should no longer live, and want to kill them and hurt the untold number of other people affected by those deaths, they should be prepared to face an adult trial, and possible the death penalty.

Yes, at 11 you are old enough to know the implications of your actions. You should be tried and punished as an adult.

investigate the parents, guardian

if the child seems to get no care or guidance
then it's not his fault

but either way the child of 11 years old would have enough mind to do adult crimes

depends ont he extent of the crime, not the extent of the injury or the outcome but the extent of the crime

for example we had some boys 11 here that beat an old man (80 somethine) with a baseball bat in public washroom in a dark park at night. they knew what they were doing, they knew what would happen, and yet they still did it.
we had two boys about 16/17 that beat a boy sensless at a party, one with a hatchet, and left him a parapaligic, the boys may have been drinking but they knew what would happen, they knew they were going to hurt him especially with the weapon of choice. they should have known better and should have seen what they were doing.
so yes, if they are over 11, they know what they are doing, if the crime is significant enough they should be tried as an adult

We generally don't think that anyone under 18 is capable of committing a crime. This is why minors are not convicted of a crime, they are found "delinquent" under the W&I Code. Many youth under 18 are tried as adults as an example. From a legal stand point I understand the need for a set age such as 18, but I think people should be held accountable in a moral sense when they are able to distinguish between right and wrong. Some people learn and develop faster than others, some have diasabilities and struggle with ethics their whole lives.

7, 10, 12, 14, 15, 16, 17, 18, 19, 21, 25 ....depending on the geographic location you're in, and what you're talking about.

For example, at 12, youths can be arrested, charged, detained, tried, and convicted under the youth version of the Criminal code. In England, for example, children age TEN can be arrested/tried/convicted.

I don't think they should be sent to adult court, but I think they should be sent to juvenile court. I think anyone over the age of 7 should be eligable for trial, not for jail time, but for mandatory psychiatric treatment.
In Ontario, where I live, kids younger than 12 can't be punished by the legal system in any way. There was a child in my area who bashed a 6 year old girl in the head with a rock, intending to rape her when she was unconscious. Then he got her pants off and realized he was too young to really do anything, and he just left her there, passed out in the bushes.
This actually happened. And the cops couldn't do a damn thing because he was too young.

I do not think the average eleven year old can comprehend what is going on in a adult courtroom regardless.

depending on what they do the brain isn't really developed till around the age 18-21, I did alot of stupid stuff when i was younger and didnt mean any harm

Key word is ADULT. NO, they are not adults why try them as adults? Can they buy Beer or cigs? Nope. They are kids, treat like them kids.

The problem isn't the age of the kids - it's your system.

Americans like a revenge-based and punishment-based system. This type of system turns criminals into ANIMALS in jail - it's not an improvement.

In Canada, we try to rehabilitate the criminal and we have a variety of ways to do it.

We spend less per capita on jails than you do because we don't jail as many people.

We use restorative justice ( a concept that we got from our aboriginals) where it is appropriate - it works.

Our crime levels are nowhere NEAR the levels that you have.

That tells me that your system is doing something wrong.


And you want to throw children into that system.

Are you going to send them to penitentiary as well - let the child rapists savage them? You might as well prepare yourself for the monsters you'll be creating - those kids will be unsalvageable.

No! While they are old enough to distinguish between right and wrong, kids teenagers are just beginning to put that knowledge into action to see and learn from the results. It's my belief that the violent juvenile offenders end up getting into trouble as a result of a bad home situation, because my guess is that most of these crimes don't occur in the home under the supervision of a parent. Trying them as an adult would be unfair because they still are not an adults, though they have committed an adult crime. They are still developing and changing where they can become someone that is not a danger to society. An adult already has their personality and habits fully developed, so are less likely to change and continue to be a danger. So they should be sent to juvenile court, unless they are very close to being eighteen.
