A lil over a year ago we were robbed of over $20,000 of items... the court date is coming up very soon and we were called yesterday by the pros. attorney and was asked if we would drop 2 of the 4 felonys on this criminal lol..... i went and spoke to him today and he said there wasn't anything we could do b/c they were capable of dropping 2 of them if they wanted to and we couldn't do nothing about it....he also said that we would be better off dropping 2 of the felonys bc there was a better chance he might get jail time but no guarantee.... apparently it is all about who you know and who you blow but this isn't the first time this young man has been into trouble and now they are already giving him a break.. Apparently we work to have what we have and it is ok for some piece of crap that has never worked a day in his life to come and take it and not get anything out of it ...... what should we do ???

I'm no attorney. But it doesn't take a degree in law to know that the laws seem to protect the rights of the criminal -- your perpetrator is apparently a convicted criminal -- more than the rights of his victims.
I heard once that the philosophy is that it's better to let a thousand criminals go free than to punish one innocent person unjustly. As a result, the morons punish a thousand innocent victims (maybe several thousands) by letting the criminals go free, or by merely giving them a "slap on the wrist." There was a TV series some years ago called "The Paper Chase." In it, a law professor said to his students, "You come into my class with your heads full of mush and you leave thinking like attorneys." I'm not certain mush isn't preferable.
To your problem... I'd ask the prosecutor if he's representing you or the municipality. If he's representing the municipality, or if he has any doubt, and if you want your rights protected, you might seek legal representation. From that time on, every time you speak to the prosecutor, or anybody else about the case, I'd have a friend (the attorney) present. It might not be inexpensive, but, if you have to take action against the municipality for malfeasance, it might be worth it. You're not going to get anything if the criminal is convicted on all four charges and sentenced to a healthy term as a three-time offender. In that case your own attorney will be your responsibility. But, if the guy gets convicted on only two counts, or gets off, or gets a light sentence for whatever reason, and if you take it to court and your own attorney wins, you might get costs and damages... in which case, your attorney would be able to make some good bucks... and so might you.
As I said, I'm not an attorney, but I'm not afraid of them, but, as I'm looking at the problem from the perspective of an outsider, I may be able to see stuff that somebody who "thinks like an attorney," or somebody who's involved might not have seen. |

they are in plea bargaining. this is how many if not most crimes are resolved. save the expense of an expensive trial, and bad guy goes to jail. |

So you think you really have the power to control what happens? This is a CRIMINAL procedure, meaning all the power of what he is charged with is actually in the hands of the District Attorney. They would like you to agree to the Plea Bargain is my guess. They don't need you to, it just sounds nicer if you do. They can do it without you. As to threatening to raise hell it won't do any good. The news would talk to the D.A. The D.A. would explain it was a PLEA DEAL, and YOU'D look like a fool as you press harder to get something out of it. Most would be AGAINST you wasting taxpayer money on a trial over getting a plea deal. |
