Excellent question. I am not an attorney, but I would guess the employer would be responsible for securing the work environment on behalf of the employees, even if it is someone's private home. Thus if you are self employed, you are responsible only to yourself. And the only way for the employer to safeguard against a lawsuit would be to only accept jobs at nonsmoker homes. |

A home is private property. You don't have the same rights as if you were to enter a public area. Even though it is your "workplace" you have made the choice to work in that environment so any rights you would've had are pretty much forgone. I'm not saying they can kill you, but they have the right to smoke in their own home regardless of the wishes of the company present |

U have the right to ask them not to smoke in front of u ...even if it is their house , its all about second hand smoke .... If they light up u can leave or refuse to do work for them ...

I hope things don't ever get that politically correct. I live at home and can't smoke there but it has to be up to the person who owns the house what happens about smoking. Would think that most smokers wouldn't smoke around somebody if they asked them not to. Really think we need more sense and not more laws. |

Wow... I see where you're headed with this. I never knew cigarettes were the cure for fascism. You're worried about someone else smoking a cigarette in your holy presence- IN THEIR HOME? YOUR rights? That is pretty selfish.

If so why don't you refuse to work in homes where there are none smokers.
Then wave goodbye to your buisness.

I used to go with my husband on calls for electrical problems and believe me, what you come in contact with in some homes, is far more hazardous to your health than someone smoking. Yuck!! |

Assuming that you're self employed, you have a choice whether to take that work/task on or not. In the negotiations you could explain that for health reasons while you are working there, are they prepared to refrain from smoking? If the answer is no, then you have a choice of whether to accept the work or reject it. |
