Yes, take California law. If you are arrested they have 48 hours to file against a defendant or release him. They can file, but have to add a arrest warrant so they can arrest you.
So yes, they can charge you. Bye the bye, a lot of people think it is 72 hours, but in California, it is 48, not counting weekends. |

She can file a complaint a year or more after the event. The sooner she does it the more valid it will be. Once she files the complaint the cops will have to follow up on it. If they think there is sufficient evidence, they will arrest you for battery. I do not know where you got that silly "72 hour" idea as they can arrest you weeks or even months after the complaint is filed.
Your best bet is to either file a complaint against her first OR stay out of her way and hope she does nothing about it. Either way, it is a gamble. |
