Social Services took our son from us! Why?
Find answers to your legal question.

Social Services took our son from us! Why?

We have a 3 year old son with developmental problems and problems growing. We have been taking him to a doctor to have him treated with this since he was 4 months old! He even gets behavioral therepy from the state each week. He has been seeing many specialist since he was 4 months old as to why he is having a hard time growing.

Our son's doctor admitted him to the hospital for some more tests and observation. While we were there with him, a student nurse called Social Servies. They came and rudely questioned us, but we had nothing to worry about, because we are doing everything we can.

Well, the next morning, they came and served us protection orders, and said that our son is now theirs until further notice. They forced us to leave and had cops there. We never even got to talk to a judge, etc, they just made this desicion on their own. They acussed us of severe neglect, and made up so horrible accuisations. For example, they stated that we lock our son in his room ALL DAY, and put him in restraints!!! Where would they get this idea? They have no witness, proof, pictures, videos, anything to back up their accuisations! We, however, have ALL the proof that our son is NOT treated like this at all! But they wont hear us out, and now they have taken our son from us.

I really dont know what to do. They wont talk to us anymore about the case, and i have no idea when i will get my son back, if i even will. We have done nothing wrong! They didnt even question our family of friends about anything, they just took our son. We, along with our family and friends, are extremely upset and angry.

There should be a 72 hour hearing coming up (meaning 3 business days). You should get a notice of this in the mail. Get to that hearing with all of your evidences! Bring a lawyer if you can. Often these things are seen to be a mistake and can get dropped. Hospital personnel and CPS investigators tend to err on the side of caution, and judges know it.

A couple of years ago my husband and I had a similar experience with rude questioning and my son being taken away. But after a couple of hearings the Neglect charge was dropped.

Get a lawyer!

Get a lawyer NOW.

That's the only way you're going to find out where they're getting this stuff, and it's the best chance you've got of getting your son back.

Call Legal Aid, or your local Children's Rights Association.

Maybe they found something in his tests that may have led them to think this? Or maybe during observation, he might have said something to let them think that... Or perhaps this student nurse was upset/jealous for some reason, and decided to be spiteful?

You sound like a good parent to me! I would contact a lawyer right away!

This is happening all over the country at an alarming rate to people who are good hard working and have the means to take of their children. My heart truely goes out to you I can't imagine the feeling and pray that I never have to go through this. You can look further into this I would start by youtubing keyword: eugenics, child services, vaccines, etc. There is an enourmous number of Americans going through the same thing, try to educate yourself and find others to form a group the worst you can do is try to fight alone. God bless and all the best!

get some legal advice, and contact the Society that deals with your son's condition, they may be able to give you advice and support, possibly go to your local paper. There must have been a court hearing before your son was taken , get hold of the judgment so that you are clear on what you have been accused of, there may have been bruises or the neighbours may have made malicious statements about you. Make sure that your home is clean and spotless as you will be under scrutiny for some time, if you have drug or alcohol problems seek treatment.See your M.P.
Don't lose your temper with officials, keep newspaper cuttings, stay positive, good luck.

I agree with everyone else; you do sound genuinely concerned.

However, it also sounds as if Child Welfare Service is genuinely concerned as well. If you're a good parent-- you're still a good parent. Don't let this make you feel differently. Also, don't allow this situation to make you lose faith in the "system." Everyone's focus is what's best for the child. Even if the most ridiculous, far-fetched allegations came up, the child would still be removed while an investigation took place.

Awful things happen to children-- and Social Services sees too much tragedy. They just want to make sure they prevent a tragedy when at all possible.

Until you find out for sure, we (including yourself) can only speculate on why the child was taken. It's possible that a family member, friend, enemy, neighbor, or doctor suspected some sort of abuse and decided to report it. It's possible that there's some physical symptom on your son that could point to abuse, but also points to his medical condition. There's so many "maybe"'s.

As everyone else said, you have every right to know why he was taken, and you NEED to get a lawyer as soon as possible. If you cannot afford one, you can likely find one who would do a case like this pro-bono.

Again, try not to be angry with anyone. I know it's an incredibly frustrating and disheartening situation, but just remember that the people who took your son do not know you personally, and all they know is what they were told. Everyone wants to protect your son, just like you want to.

i was in cas(but for good reason) they are definately higher then the law if you have nothing to worry about good. invite them to inspect your home tell them they could drop by any time the wish if they have any concerns do you know anyone who would call them ? if you were neglecting him you wouldn't have been in the hospitol or taking him so regularily to make sure he was ok not to mention the behavioral testing . when/if you get your son back sue them for false accusations and severe emotional distress.

Chloe
TIme will tell. Just wait a bit for everything to be explained because surely they didn't take your son because they just simply wanted to. You will have time to explain yourself and you will get your son back. YOU WILL GET YOUR SON BACK. I know.

if they have taken your son, you have a right to know exactly why they did it.

I'm going to chose to believe you, because you do genuinely sound upset about this.

i cant really help you,
but do everything you can, and dont give up on your son,
i really dont know how they were just aloud to take him without even a decent explanation. they must have got some inside information from someone close to you, so someone around you has probably reported you.

i hope you get your son back,
good luck

I know everyone else has said this, but you need a lawyer. However, you need a really good lawyer, so that they can do all they can to help your son.

So search for an excellent, well-known lawyer who can almost guarantee to get your son back... however much it costs, it's worth it, right?

I'm sorry to tell you this but there is the slightest chance that they are fake and kidnapped your kid.

Oh my God! This is a horrible situation and I feel so sorry for you and your child. I can't imagine why they would take your son from you other than it is the procedure they must follow when they receive a report of abuse. They protect the child first, then investigate further. I'm sure that once they have had a chance to review everything, you will have your child safely back with you. I would retain a lawyer and have him/her handle your side of the investigations because they will have your best interests at the forefront. Once your child is back with you, I would then use your lawyer to sue the student nurse for all the pain and misery she has caused you and your son.

the government has adopted this philophy of liberal societal responsiblity draconian idea that the state always knows best and until incidents like this become more widespread, reported and severe people will tolerate it, sadly. But, right now, for you, you need to fight back any way you can in the name of freedom.

Someone wants to have revenge with you. Or the doctor thought that the child was not well treated and due to some symtoms the doctor denoted it, well they can be miss understanding names. For sure I am guessing that someone is wanting to harm your family, due to wealthiness and many joyful time.

It had happened to me. The person wanted to harm my family. Fortunately
we had traced the man. He was not sent to prison but he paid a caution not exceeding Rs100,000. I'm from Mauritius.
