the best way to deal with this bad payer is to sell on the debt call in a firm of debt recovery agents they will pay you the sum you are owed so this guy then owes them the money not you give them his details and they will track him down and get him to cough up the poppy good luck

Go to small claims court, but I would honestly suggest that you leave it out of the court system.

210 dollars is more of a principle lawsuit and probably not worth the judges time, but of course-it is your prerogative.

EDIT: Do you have any witnesses to him agreeing to pay you back? If not-tough noogies.

In Texas you can legally record a conversation without advising the caller, as told to me by the Sheriff. They said that 1 of the 2 parties must know, and you know you are recording yourself, so therefore it is legal. This will give you leverage should you go to a court of law.

Document, document, document. I'm sure they will say it is a gift. Cover that in the conversation. Then send them a bill. Ask for $5 to "start paying off" the item. If they pay any, this will show they knew it was not a gift. You don't volunteer to pay for gifts.

Send them a bill in the mail. This will show a legal attempt to collect a debt. And keep all records, copies, statement, list when you call, what was said, etc. Record all as evidence.

If you can get them to pay "some" this will establish that this was a loan, not a gift. Then you can take it, along with all the evidence I mentioned above, to small claims court. It will cost you to file, but if you win your case, they might be required to pay for court costs and filing fees. Hope this helps.

Hopefully this has not hurt you financially. For now, document what you have done, be sure to list dates. And keep it. Write him at his school using a professional attitude about it. Ask him to please pay his debts, and send him multiple bills once a month consistantly. Don't harass him. Remain calm. He will thinks twice about embarassing himself at his workplace, as long as you remain calm and level headed, and remain professional you should get something.

You should be able to contact him at his workplace, to collect a legal debt. But don't cross the fine line of harassment. Then he would have a countersuit against you.

You might only get an answer from him, not cash. But it might be the answer you need to win your case. Remember to document everything so you don't have to show up for court empty handed with "your word against his". Let a judge decide. Most people don't show up at small claims court pretending to want $210 when in reality, if they were making it up lieing from the start, they would lie and ask for a whole LOT more.

Take your receipt for the print, your proof of shipping, then file a small claims action against him. If he's still in NYC, then go to the small claims clerk in the civil court for the borough where he lives. If he's in Manhattan, then you would go to 111 Centre St. It costs $15 or $20 to start a small claims case. They are all about $210 cases, so don't worry about the amount - that's what that court is there for. You may want to first send a demand letter to him. Give him 10 days to pay or you will have to take legal action. If he still fails to pay, then you look good when you go to court. Judge's like it when you make attempts to resolve a case before resorting to a lawsuit.

You can file a civil lawsuit against him, which should costs about fifty dollars. First, you should mail him a certified letter requesting payment for the poster plus shipping costs. Enclose copies of receipts and let him know that if you haven't received payment within thirty days you'll file suit. If within thirty days you haven't received the money or a reply consider suing. You'll be sending the certified letter to him to show the judge that you did attempt to get him to pay. Make sure you have all receipts before you file suit.

Call his university and speak to his prof about the money owed.

Tell the prof that you're worried because your friend isn't answering his phone any more and you're wondering about the money he owes you.

He'll be furious, but you will probably get paid faster.

If that doesn't work, sue him.

Notify him several more times that if he does not pay by a certain date you will take him to court. Make sure you somehow document these instances. Then if he still dosnt, take him to small claims court. You probably wont win anything if you dont have proof that he said he would pay you back, but the idea of court might scare him into returning the money. Hope it works out for you!

maybe he got caught up with homework give it time maybe he is still paying back and temperarly doesn't have the cash. After time if he still doesn't have the money call him if nothing happens hunt him down.
