Well, contrary to Champagnes answer, spitting at someone is actually a form of assault, especially when AIDS and other transmittable diseases are contained within the saliva.
As to whether you can sue depends on the lead up to the incident, i.e, what did you do to gain this unwanted attention - you could be equally guilty of a charge.
What do you hope to gain from the court action? compensation will be negligible unless you can prove a long term debilitating medical problem - you do contract AIDS for instance, otherwise the court costs will be far more than you would probably want to pay.
You really need to speak to a solicitor for proper advice on this matter. |

You have every right to press charges and sue, it's is a form of abuse, and it's is very degrading.
If that person has communicable diseases, this can be a very serious issue. |

Glad to hear your pressing charges.
It's a filthy thing to do... i mean what other alternatives are there, punch her? no that's not an option. Spit back at her? .. nope.
You should press charges first im sure it would make the option of suing her a lot easier, as the guilt has already been established. Then only thing left to establish is how much compensation your entitled to.
BTW that "man card" stuff is utter crap.. it takes more of a man to press charges and stand by your rights than it does to hide and do nothing. At the end of the day this is 'assault', which is what it is.

It is a common assault, punishable in law.
If you wish to press charges visit your local constabulary and register your wish.
If the Police were called, the incident will have a crime logged number which will be a record of the details of the assault.
The Police will probably suggest that you consider the effort involved in investigating the crime, interviewing witnesses and time spent in court before you pursue this case.
It is probably best dealt with by a Police caution. |

This is a case of assault and therefore a criminal offence, ask the police to press charges, this is disgusting behavior only worthy of a camel.
If this offender does not get a fine and you damages, at least you know she will get a criminal record.

It is a matter of self respect. Too many times scum such as the woman who spat at you, are let off. so you press charges for assault. yes you can sue her. it depends if you want all the hassle. But as i said it is about your self respect. Why should you put up with crap like that. i would definitely have her charged and i would sue her as a matter of principle. I am a tough ex Prison Guard and have dealt with all manner of incidents. i am not too proud to try to ensure scum like her does not feel she is fireproof. |

i don't really see on what grounds you could sue the person on, its not like you have suffered any loss coz of the incident.
the police may feel its not in the interest of the public to charge this woman and just give her a caution and there's not a lot you can do about that really.
but you could take out a private summons for assault but what is she likely to get for it, bound over to keep the peace, a £80 fine for public order offence.
its not worth it mate, you had the last laugh leave it at that |

This would qualify as common assault, so you could report it to the police. Unfortunately I suspect the police / CPS will be unwilling to formally prosecute her for such a minor offence, but they should certainly be prepared to speak to her about the incident, which as Jory says will probably result in a caution.
You could also sue her for assault in the civil courts but I don't think it would be worth it. You would have to show that her actions caused you injury and / or financial loss (such as the cost of having clothes cleaned) to be awarded any damages. There is no compensation for hurt feelings alone, I'm afraid! |

Pretty disgusting, that's what comes of working in a bar! Why would you sue her though? Get her arrested and charged etc, but what damage did she do to you? Pretty much an occupational hazard I would think. |
