Swimming Pool Codes regarding Fence & Barriers?

I'm confused?? I need to purchase a fence for my in ground swimming pool... now my property is already fenced in with a 6' high fence so this will be an additional fence only around the pool to keep my 2yr old out.
I'm confused regarding the width that the fence has to be from the water.. we currently have a 3ft cement walkway around the entire pool and I would like to have the fence butt up right against the walkway so not to intrude into my backyard. this will make a nice 3ft fenced in path around the pool. I checked the NYS Pool Code and the only requirement is that the fence must be at least 48" high. Nothing about how far it must be, but everybody I ask says it must be 5ft away from the water?? So should I check my local county or town pool code? and where do I draw the line> do I go by NYS code, Town/local Code or County Codes???!!??

I have been looking at property, and at least in Texas, I have seen fences go right up to the water line. I think, though, from a legal standpoint, since you have a privacy fence around your yard you are covered as far as the 'fence around your pool' rule.

I think any second fence woud be to your personal preference. I have actually seen temporary fences that are mesh and can be taken down, but can hold the weight of an adult who might fall into it. That may be a good option to look into, as you will be able to remove it if you have a party without little kids or something.
