The ballifs have threatened to come take away all my belongings ,can i refuse him entry when next he comes?

he had gained entry once to take details of belongings

You should never have let them in in the first place.
Now they have got all the details and had your permission then they (I believe) can force entry next time.

They could not force entry the first time, they had to be invited in.

Can a bailiff force his/her way into my house?
Most bailiffs do not have the right to force their way into your home to seize your goods. The only exception is that bailiffs from the Collector of Taxes (Inland Revenue) can get a warrant to force entry, but this is very rare.

All other bailiffs have a right of peaceful entry only. This means that they cannot use force to enter your home, for example, by breaking a window or a door. However, they can enter your property through an open door or window (front and back) and can climb over fences and gates, but cannot break them down. See also ''If a bailiff does gain peaceful entry to my house, what will they do?''

You do not have to let a bailiff into your house. A bailiff cannot force their way past you if you answer the door. If all your doors and windows are securely closed they will not be able to gain peaceful entry to your house unless you let them in.

Bailiffs are well aware of their limited powers and may use a variety of different means to gain entry peaceably. They may attempt to walk in as soon as a door is opened. They may ask if they can use your telephone to check if an arrangement is satisfactory with their office. They may simply ask you if you would prefer to discuss matters inside. You do not have to go along with any of these methods.

If you don't let him in he is not allowed to break in, just keep all windows shut and door locked.

I think they can only take away anything which has a re-saleable value and which is not essential for you to live - ie can't take your bed!

You need some good advice - go see your citizens advice bureau

unfortunately not, as you have already let him in, but please seek professional advice at the C.A.B....they may be able to negotiate to stop this

Mr S London (XLIII)
The Bailiffs have Legal Right of Entry once you have let them in to your Property the 1st Time ! You should NOT have let them in to your Property the 1st Time !

The walking dead
Just don't let em in, once their in you are done for. the y can't force entry, but if you leave window open for them to gain access that's lawfulf

Yes you can refuse him entry (unless it is a Baliff from the Inland Revenue), they can only enter your house if you allow them access or they gain access through an open door or window.

Read the info on this link, it explains some tricks that they will try and use to get past you.

http://www.insolvencyhelpline.co.uk/debt_basics/bailiff-guide.php#bg7

Best thing to do is call them and try and come up with some sort of payment method - they will try and make you pay a large amount but explain you can only pay so much.

Good luck

I think they can gain entry by law if you actually open the door & if theyre is a window open they can get in that way etc. get together all your receipts & give them a family member & sign your car over to someone you can trust too. They can't take it if it's not yours!!!!

This is the link you need

http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=02_bailiffs_and_council_tax

Once the bailff has been let in and taken an inventory there is little you can do to stop them coming again. After reading the link phone National Debt Line to get details advice from a real person.

kezzer
If a ballif has a court order then there is not much you can do unfortunately. If how ever it is just a debt collector yes he has no right to enter. For a ballif to be sent there has to be an order from a court.

Check this and seek debt advice.

You have already let him in therefore he is allowed to enter your property in the future. He cannot force entry only through open doors or windows.

they have right of access to your property, but make sure they are legit by ringing in their firm, also check all id as much as you can. legally you cant stop them from entry, if you do its classed as breach or peace and the cops can do you for that

Ask to see the court order before giving him access. Usually if the bailiffs expect trouble they will bring a policeman with them. You to can ask the police to attend and to act as check on the bailiff. With the court order they have right of entry. They can with the law on their side break into your house.
