The co-op that I work for has over paid me the last 3 paychecks?
Find answers to your legal question.

The co-op that I work for has over paid me the last 3 paychecks?

my job for them,is to assist a special needs child during a school day. I do not take care of the books/paychecks. Can they legally take that away from me in a lump sum? or in portions?
I live in Illinois, and yes,I have notified them about this.

i would inform them immediately that you are now used to that sum of money and refuse to take care of the children until they pay you what you are now used to

well in my opinion they can take away any over payment in the way that they choose. So it could be a lump or it could be to pay you less each time. You need to talk with them about how the intend to handle this situation. If they access to your bank account you need to be prepared to have them remove what they over paid you. This can make your fiances shaky, so you might need to close out the account to prevent this from happening i hope that ur problem gets solved

You did the smart thing, but you also did a dumb thing. Unless you were smart and put that extra money aside for the eventuality they would ask for it back. In any case, even if you didn't tell them they would find the mistake once they audit their books, trust me on that.

I hope you put it in an interest baring account.

As far as paying it back, they can take it in a lump sum. You can ask them to stretch it out of a period of time, say a few months. However, they may look down on you with distrust from that point forward if you don't pay it back in full.

Again, you did the right thing, but you may have done a dumb thing too.

Peace

Jim

They're perfectly within their rights as far as I'm aware to either ask for the excess back or reduce a future check(s) by the difference. Since you were stand up about it, I would think they would work with you as far as how to go about doing it if money's that tight for you.

Well, good for you for telling them. Yes they can recoup the overpayment regardless of whose fault it is. So just kind of set that money aside so you can cover your obligations when they offset your salary to get the money back. It's too bad, but that's the way it is.

If they overpaid you I don't think that you have to report it but I think that if they make a mistake wouldn't that be their fault?

It's hard to interpret red tape. I would say you have your bases covered. They will most likely ,when the gears move, ask you or tell you how much you owe them. Then they will prefer a payment in full. That covers their mistake in their eyes. Yet it is up to you because you didn't ask for their money and reported the discrepancy. So what I'm saying is the money is in your hands. If you ask my advice I say pay them what they deserve.

Most likely they will adjust your next paycheck to account for the overage...

Chihuahua.... don't let anyone know...
edit:
originally it was "Shhhhh... don't let anyone know..." then I let the spell checker at it...

if paid direct deposit, lump sum, one of the little pieces of paper you sign says they can pull it back out in case of an error, for the amount of the entire deposit. And then they can reissue the "check" again.

Brought to my employers attention that they had paid me double time for the whole week once... they fixed it the next paycheck...
that was an ouch, try living off $7 for a week.

Movinonup
Good for you telling them. They can however take back their money. BUT - it would be totally unfair to take a lump sum from you! You should be able to negotiate a payment schedule so it doesn't hurt too much... Unless of course you saved the extra money and can repay it without any inconvenience...
