If the police arrests you, says that you a member of a terrorist group, the burden of prove is on who to prove that you are or you are not a member of a terrorist group. Police have suspecision, asks you to come to court and prove that you are not a member of the terrorist group? can they do that?

UK reply
NO.
It's the other way round The Criminal Prosecution Service have to prove beyond reasonable doubt you are guilty.
The CPS just tried to get the people convicted who helped the 7/7 bombers. Their case was not good enough.
So the accused are innocent and not guilty. We shall never know if they are really innocent or as guilty as hell - but it couldn't be proved "beyond reasonble doubt". |

From UK.... No I don't think it works like that. Court cases cost a lot of money to prosecute wherever you live in the 'free' world. In order to get to court, they would have to build a very strong case based on 'reasonable' evidence.
However, the police are within their rights to stop you and ask you to prove who you are and what you are doing there at that time. That is what we pay them for. Then it's up to you to identify yourself and give a good reason why you are there doing what you are doing. If you can't prove who you are and prove that you aren't up to no good, then they should arrest you. |

Look: The average criminal probably lives next door.
He gets away with it because the average person abrogates his
responsibility to police his own area/property to
the police...who are increasingly unable to cope....
You THINK because you are an average person you are above being arrested
for any offense ?....wrong....half of arrested persons are released...
If you think by agreeing to the removal of any civil rights you will
lower; crime...wrong....you won't...all that will happen is that innocent
people will be imprisoned....don't forget...there's no smoke without fire.
..if you get arrested a load of your friends will say just that..
Always remember:
Crooks don't obey laws.
They also tell lies.
So, the police start from that premise.....
you're just another lying crook if arrested.
And it doesn't matter if you're guilty or innocent....
the legal profession still gets richer....
It is better to die on your feet than to live on your knees. |

Under the Bush Administration you would be absolutely screwed. Are you a terrorist? Are you a citizen of the US? If you are an immigrant from a country that is known to harbor terrorists, then yes they can do that. And I don't blame the USA for taking such a hard stance. Don't **** with us. You can bomb our cities and crash planes all you want. There are enough citizens in this country to re-band and kill you. When that happens there will be no laws to protect you. |

Under Habeaus Corpus (English Law) The crown prosecution service must prove your guilt, but under Corpus Juris (EU Law) which overrides English law it is the defendant who must prove their innocence. |

In the US, under bush it was up to the defendant to prove he was not a terrorist, under Obama it is up to the state but they can hold you |

The burden of proof in ANY trial is on the prosecution..........The prosecution has to prove beyond a reasonable doubt that you are guilty. |

There are only a relatively small number of proscribed terrorist organisations in the UK.
While in would be for the police to prove that you were a number of a proscribed organisation. The police would not ask you to come to *court* to prove your innocence - that isn't how prosecutions work - but they might ask you to come into a police station to make a statement if they suspect you. If that is the case, you aren't obliged to go (if they really want you to come in and they have evidence, they'll arrest you). If you are going to make a statement you should consult a solicitor first. |
