This doesnt seem to be legal?

i just got pulled over by a police car for doint nothing wrong... i mean nothing wrong, when i asked him what i did, he told me that he would tell me later and that i needed to get out of the car because it needed to be searched... now to tell you i am a white 18 yr old girl who is a full time college student maintaining a 4.0... so he couldnt have used race against me for a reason to search my car, i have never been arrested and have absolutly no record, and did not act under the influence of anything because i dont believe in doing drugs/alcohol... when i asked him the reason to search my car, he told me he would tell me later... he then wanted me to sit in his cop car, and when i told him no because i dont know what i did wrong, he called another cop to watch me... (i am a 110 lb 5'5 white 18 year old girl what am i gonna do?)... the other cop then asked me " why dont you want to sit in the cop car, is it because you have something bad in your car?"... i felt like i was being treated like a criminal, and i didnt do anything to deserve this and he had no reason to pull me over in the 1st place... the cop that pulled me over then told me that he pulled me over because i failed to yeild to him and the reason he searched my car was because "the sheriff told him that they were looking for the same car i had"... and when i asked him to explain to me what exactally i did, he told me that if i kept talking, i would get a ticket... the last time i checked, the cop had to give a reason to search a vehicle, and if there is none, then i dont have to get out of the car???

I would contact their chief and register a complain with internal affairs. Since you had not done anything wrong he has not reason to search your car and cannot do it without your consent. So talk to their boss about this and demand that the officer be investigated for this. If they still don't do anything i would probably contact your mayor and/ the governor. You could also involve the local media about this too if you want and they will listen. Seems to me like the officer was clearly abusing his power and not only that he illegally searched your car. Seems to me clearly that they have violated your constitutional rights . It would of been different if he would of explain everything to you in the first place.

According to the 4th Amendment : The right of the people to be secure in their persons , house , papers and effects against unreasonable searches and seizures, shall not be violated and no warrants shall issue, but upon probable cause , supported by Oath or affirmation , and particularly describing the place to be searched , and the persons or things to be seized.

Get a lawyer. That's illegal search and seizure, and I'm fairly sure it's also some type of harassment.

Well actually he is suppose to ask you if he can search your car and you have the right to say no. He then has to get a warrant and/or get the drug dogs out there to sniff around your car.

Ok - firstly, when a police officer pulls you over, don't be mouthy and don't try to defy them. Do as they say. You worry about fighting your case AFTER they let you go.

Secondly, go to the department they were with (I sure hope you got a name) and tell the clerk at the front desk you'd like to file a complaint. A supervisor will come and talk to you, tell this to the police officer that talks to you and they should be able to shed some light on it.

For future Reference, tell them you want to see a search warrant. Otherwise to get out of your car.

Doesn't matter if its legal or not, they are going to do whatever they damn well please. Do you really think they need a reason to drag you out of your vehicle & search it? These types are not your friends, they are not looking out for your interests, they have chosen the position they are in for power &/or revenge.

so he had to call for some one to watch you since you would not get in the cop car ...you are lucky he didnt cuff you for his own protection
