Ticket scalping - what's the rationale for making it illegal?

If I can buy a baseball playing card at a lower price and sell it at a higher price this is legal. I can do it with TV's, iPods, lawnmowers, antiques, houses, businesses, golf clubs, etc. It's legal with just about everything. So why is it illegal in many places when it comes to event tickets?

Most things on Craigslist are tax-less, cash transactions. Tipping also. There are many things that fall into this category that are perfectly legal.

You speak as if these tickets are a necessity and that scalping is a risk-free and foolproof business. The scalpers (in theory) recognize an inefficient market condition know as an arbitrage. In theory, the tickets weren't offered at a significantly high enough price to begin with. Scalpers can and do lose money.

Price gouging? That's an emotional term with very little real-world value. If the tickets are too expensive, you don't buy them. If you agree to a price....either with the vendor or the scalper, you establish a "fair market value". There is a difference between a "fair market value" and the price that something is offered at. Fair market value is not universal, but rather exists between a buyer and a seller.

If people are stupid enough to pay the higher prices then more more power to the ticket scalpers.

Because then people would buy hundreds of tickets and then sell them at super high prices. If they buy all the tickets then you would have to pay their huge prices to attend the event since there are none left.

Also scalpers are not running a legal business therefore are NOT paying any taxes on the money they are collecting.

Price speculation is fair, price gouging is not. Scalpers buy so many tickets that the general public do not have a chance at buying the tickets for the original price (fair market value). This leads to the general public being forced to pay more for the event ticket from the only source with tickets-the scalpers.

Your baseball card might go up in value over time and it might not. The same for antiques, homes, etc. It is a risk that you take. Scalpers reduce the risk by creating unfair market conditions.
