The suit is almost 10K and it includes bad checks that already have a warrant. That's in NEvada. I sent the certified mail, the person was not there and they left a note to pick up but she never did.

No, you can't send a letter. You have to Summons the person and it has to be personally served on the Defendant. Your local district court should have a copy of the form. Am I correct in assuming that you are pursuing this by yourself? Well, Nevada helps a bit by having a number of standardized forms available on-line: http://www.nvsupremecourt.us/sitemap/index.php#sm_selfHelp.
However, I would strongly suggest that you consult an attorney. Its been a while since I had an active Nevada case, but I seem to remember there being a statutory right to recover attorneys fees in a bad check case. Its worth looking into for you. |
