Under age at a bar and was sent to the hospital for 37 stitches in my arm can i sue?

i was hit in the head with a beer bottle and sliced with the glass... can i sue... cause i heard that i can but i am affraid that it will come back on me becuse i am under age... and if i did sue they can most likeley file for bankrupcy and it will not matter anymore right?

Unfortunately, the answer is yes and you would have a pretty good case. weather you were drinking or not does not matter, in fact, if you were not drinking, the bar still has an obligation to provide safety to it's patrons. If you were drinking and they served you alcohol, then they were doubly negligent for serving you and not providing for your safety. All this is of course assuming that you are refusing to take any responsibility for your own actions which I believe is morally wrong. But then again, not having morals is not against the law, and again, thats unfortunate.

sure, you can sue for anything you want.

but this case reminds me of the guy who had his apartment broken into and he called the police to report that his marijuana was stolen.

If you are American you can probably sue and win becouse everyone seems to do it there. In Canada we do not sue as often but accept responsibility for our own actions.

Well, the bar owner is responsible for keeping underage patrons out of the bar, yet he is also liable for damages, personal or physical, that happen within the bar. Bar owners have insurance for these purposes. I would contact a lawyer and be truthful about your age. In cases where a person was hurt, most lawyers will give you a free 1/2 hour consultation. You should be able to find your answer in this time. And what you discuss will remain confidential.

Sue? Who? Your parents for raising your poorly? Your friends/boyfriend for bringing you there? The bar, for letting in undesirableviolent/drunken characters? Or for not carding you? The person who threw the beer bottle? (At least that one makes some sense, although without a criminal conviction, I'm not sure of your chances.) Or how about yourself for going there, for not ducking, for not leaving at the first sign of trouble or for presenting a false I.D.? Truly, who do you think should be RESPONSIBLE for what happened to you?

Added: And by the way, if "they" did go bankrupt over your lawsuit, (which you are not old enough to file), it might just matter to..."them".

You can sue if you can get an attorney to take the case. Good luck it will cost you several thousand dollars unless you can can get on to take it on contingency which means they will got about 33-35% of the settlement if you win. And it could come back on you.

U would be taking a big risk, cause u are underage and could face charges for yourself if u sued.
Most bars barely make enuff money to buy the booze they selling.

Here's the thing...there is a drinking age for a reason. The reason is that by the time you're 21 hopefully you'll be mature enough to make better decisions and not put yourself in irresponsible situations. YOU, on the other hand, obviously don't have that sort of maturity since you were 1. in a bar illegally and 2. in an irresponsible situation resulting in harm (as irresponsible situations can do).

BTW, a civil judgement is called an award, you are asking what your chances are of being awarded a judgment. I'm curious, what do you feel you've done that deserves an award? What do you feel the bar did that would make THEM financially liable for YOUR injuries?

Or is your question, "I did something stupid, is it possible I can make money off of it at someone else's expense too?" Do you not understand that people like you are making it impossible for small business owners to exist? All their hardwork and sacrifice could end because one twit in one day decided to try and make a quick buck without putting forth any effort. Again, your lack of maturity and personal responsibility is...consistent.

If a robber can get away w/ suing a family who had icy steps and broke his/her bones or w/e, then you probably can sue the bar. But w/e. Do w/e you want.

the huge sign that says NO PERSON UNDER 21 ALLOWED would be the first thing the bar would use in its defense. You being underage wouldnt really know what goes on in bars but believe me.. there is far worse things that happen. If you admit to the police that you snuck into a bar you might be charged with tresspassing. My advise to you would be to choose where you hang out a little better and put some Aloe Vera to prevent scarring. Take the lessons you learn in life and apply them accordingly. If you still want to drink at bars... be sure to have your medical card at your disposal.

I think if you feel you are grown up enough to go to a bar then you should be grown up enough to take the consequences.If it was not your fault then I feel the bar owner should pay your medical expenses.Other than that welcome to the real world of bars and clubs.They can be violent,dangerous places and in my opinion you enter at your own risk.Do not be like a liberal and look for someone to blame.Move on and take your medicine.You learned a hard lesson didn't you.??

As a minor you can’t sue anyone. Your parents can. But the fact that a minor was in a bar in the first place…you’re opening up a huge can of worms.

First of all, they did not card you, so that is their liability for you being in there as THEY broke the law (costing them their liquor license). Secondly, what are you suing for? Being in a bar fight?

At best, you parents could sue the bar for allowing a minor to stay in their establishment and not carding them, resulting in injury to you.
