I'm Italian, I live in a rented property here in London and right now Im in a tricky situation. I have a signed contract with my landlord finishes at the end of May so as I wanted to stay here a few more weeks before going back to Italy I got in touch with her to ask her if she let me stay and if I could pay her for these weeks and stay in my house. I waited for her reply before buying my flight. She emailed saying it was ok, that I could stay, so as soon as she replied I bought my tickets. Next day she shockingly says changed her mind and that she wants me out of the house by the end of the month. Can she do that after having agreed with me? what rights do I have as a tenant? We didnt sign any contract saying I could stay these extra days, but her emails are a proof that she was ok with it and my flight documents show that I booked it after she said it was fine.
Can she force me to leave when my contract finishes then?
Can I ask her for money in case I have to buy new plane tickets as its not my fault that she changed her mind so suddenly?

P.S: Ive been an excelent tenant and she didnt have any complain about me, just the opposite as Ive treated her house as my own

You should always have something in writing like a continuation on the lease/contract with specific dates. If you have nothing in writing she has every right to ask you to leave when your lease/contract is up. An email is not a lease/contract. You need to sign a lease/contract with dates. |

Legally you do not have to leave on the date shown in your tenancy agreement.
Your landlady must apply to the County Court for Possession at the end of the tenancy and the court must (and will) grant Possession and issue a Eviction Order/Warrant. Until the Order/Warrant is issued you do not have to leave your current accommodation.
The above process is likely to take a few weeks, so as long as you remain there you need not worry about where to live for the few weeks before you return to Italy.
If your landlady tries to evict you without going to the County Court, she will be acting unlawfully and will herself be open to prosecution and may be ordered to pay you compensation. You should contact the Tenancy Relations Officer at the local Council if she attempts to remove you without following due process.

recently the courts have allowed text messages and others as evidence. your emails should suffice. its an agreement in principle.
I do not know much about London and their Tenancy Act or if they have one; but it would be worth researching to see if they do have a act or other that protects tenants.
Here in BC the email would be an agreement in principle and she would not be allowed to evict you.
Send her back a response and tell her that you have an agreement from her in writing and you intend to follow that agreement rather then her arbitrary decision to have you move immediately at the end of your lease. Use your research to back you up. |

Legally, I doubt you have a leg to stand on. Try talking to your landlord and explaining what's happened, without being aggressive or losing your temper. She may be able to accommodate you. If not, then there's not a lot you can do. |
