Waitress chased me out of the restaurant and said I did not pay the bill?
|
I have had such a hard time with eating out recently. Here is my most recent experience and hopefully after reading my story I can get some feedback on what I should have done.
My husband and I went out to dinner and finished our meal. I decided to pay in cash and left a $50 bill for our $43 restaurant check. We then left the restaurant. Once we got to our car we heard shouting. It was our Waitress and the Manager telling us we had left without paying the bill. We told them we had left a $50.00 bill in the folder on the table. WE would have liked to hand her the money directly when we left but could not find her and were runny late for an appointment.
I had left money for the wait staff on the table for years and hundreds of out to eat meals for years without a problem.
Anyway they said no $50 bill was left and if we did not pay they would call the Police. I decided we did not want to make waves so handed her $45 and drove away.
Either it was a con or the money was taken. Additional Details Its likely a customer took the money and yes, I should have handed the money to the staff, but what should I have done in this situation that day?

You could have gone back in and seen if the table was already cleared or even partially so. If another server, a busboy or whatnot had taken it they would probably do so under the guise of "helping" out. If that happened you could have said there is no way for them to prove that you did not leave the money.
The using a $50 thing hurts your case. It kind of makes it look like you were just planning on leaving 50 regardless. Most people who have a 50 in their pocket would be using a debit card. It looks all to convienient to just leave one bill that can be stolen in a heartbeat.
The other customer thing is very unlikely. You would have to have a customer who was of a mind to steal nearby, see you put the money in and then take the risk in that very narrow window of time to steal it. Plus be able to notice that there were no other employees or other customers to see it happen.
I would have gone back in and and said "go ahead" call the police. The manager or police could ask neighboring tables if they saw anybody else near the table. The manager is not going to want to have two decently dressed people standing in the dining room with cops and such around. It still could be a he said, she said thing but if you had more cash and credit cards and such on you it would have proved your case.
But I understand how you felt and just wanted it to go away.
I find it interesting that the waitress was nowhere to be found. But at that very moment you left she appears, finds no money and has time to get a manager and track you to the parking lot. Where was that manger when you were trying to pay? In the dining room? Probably not.
You should contact the restaurants owner and say that while you enjoyed the meal and have eaten there before you are upset. If it is a corporate place ask for the general manager or the district one. Most places take a dim veiw of tracking people to their cars as there are safety and legal issues.
Tell them you find how things went to be deplorable. You paid because you felt cornered and intimidated. It is shame since you enjoyed you meal. The owner or whatever will think about this and consider it all. You will have turned it all around.
In this day and age as another said....... use a debit card. If you are not quite done tell the server that you wish to pay or will be paying soon. Money usually prompts a server to come around. If you do leave cash it has to be in various denominations....... not just one bill that can be stolen by the waitress or catch the eye of someone else. In this day and age one should use a debit card for everything...... even the grocery store. No good comes from using cash. |

im a waitress. and people have done that and ive actually seen people take money off of tables because there was big bills on them. so never leave money if you are not there to see that the waitress gets it. many ppl are a$$holes these days and will steal the money. so be careful next time! |

Youi should have checked to see if they had cameras... If you left 50 on the table you loeft it there... you should have let them call the police... as a matter of fact you should have called the police right in front of them... there's no need for you to lie. you just spent 95 bucks on a meal that was 50.. I would have fought that |

The money was probably taken, at the very least, if you can't find your own waitress, make eye contact with the manager or another waitress and point to your table.
Its even possible another waitress took your money when she saw you leave, not wanting to leave it there and the manager didn't know it.
What you should have done, was pay the bill when the manager and waitress came after you, while saying that you did leave the money, and you will be leaving your name and phone number so that they can ask the other waitresses if they saw anything or if the cash draw runs over at the end of the night.
Its up to you to see that the staff gets the money, if someone walks away with it, the waitress has it come out of her pocket. |

Unless they had security cameras going on their customers, you did the only thing that was right to do and that was to pay for your meal again. If it is a reputable restaurant, they would not be trying to scam you out of $43.00. The lesson you learned could have been a much more costly one. |

If you pay with cash, always wait for it to be picked up or pay at the front desk. Someone may have seen you put cash in the folder and walked by the table and picked it up. |

It could have been either. Never leave cash laying on a table and leave.
EDIT: I would say exactly what you did, otherwise they would have called the police because they thought you walked the tab. |

I find it odd that you'ld just give them "another" $45 just like that, something's not right. IF I put a fifty dollar bill in the folder, I would have called the police for them! :-/ |

could be someone else took the cash.
Never leave the money unattended. If you would not have paid, the waitress would have been stuck for the bill. |

probably someone else took it - don't go there again and never leave money unattended on the table again |

the mistake lies solely on your part, your habit of just leaving the money on the table is not a very good idea anymore esp. inside a restaurant or any food store. Yes they are right in chasing you out to demand your payment of your meal. Everybody will do that to you esp. if the money you just left was taken by someone who is just leaving her/his table or just people just coming in to take their meal. Not everybody is an angel anymore, when temptation knocks they open it widely.
So next time do not leave money on tables, it is a lesson now to you even if how hectic your schedule is do not leave money on tables. You could have handed the money to even another waiter for the meal why leave so fast. Common sense right. Why there is only one waiter there for 50 people inside the restaurant? If you handed it to someone else then when the waitress chases you outside you could point to another waiter that you gave the money, but in your case who would you point to? No one. So it is your fault. |

Sounds like someone swiped the cash behind your back.
You should practice waiting for the waitress, or have your husgband go look for her. Never leave money on the table, un attended. |

Probably not a con on the part of the restaurant. Someone probably saw you leave the money and stole it. That is why I either use my debit card or hand the cash to the waitress or the hostess if the waitress is not around. |

anyone who saw you put the cash in there could have taken it yes including the waitress |

I agree with Boom Chikki, you should have checked if they had cameras. They can check to see that you did pay and if so, you wouldn't have to pay twice. good luck next time. |

Sounds like a "your word against theirs" situation. I don't think it was the waitress...to risky for her to get caught. Not so sure I would have given up as easily or quickly as you did. $50 is allot of money. Add the extra $45 and you really over paid for your meal. I would have gone back into the restaurant and tried to figure out where your money went to. |

So why didn't you just take you check up to the cashier and pay it on your way out? In a big hurry to NOT PAY? Oh yeah what a great tipper,2 bucks for a $50.00 bill. You know you are lying. When people walk out on their check it is stealing just like anywhere else. If you can't afford to pay the bill and tip, stay home. So that server ended up paying taxes on a tip she didn't even get. I would have called the cops, too. |

well, what could you do!!!
could have been a scam, waitress or some other costumer could have taken the money, they might not have seen it untill you left and they went back in.
unfortantally its a argument that could have never ended.
next time just make sure you pay it to some one directly. |

I read all of the comments on this post and I can say most people on hear are complete idiots. You have every right to walk out on a bill. At the point you walk out on the bill, for an actual reason, i.e. meaning you did not intend to bail out on the bill when you went to the restaurant, the establishment has to pursue civil action. Enough said. |
