was Robert Fassbender ever convicted? He faced 77 years for stealing a pack of donuts because it was his third strike (California)... but did the panel ever convict him and is he serving that sentence?

He was convicted, yes. His appeals of the three-strike determination have yet to be exhausted.
It's worth noting that since 1979 the longest that Fassbender has ever stayed out of jail is 2 1/2 months. He has over 50 convictions. Of those, over 2 dozen would have qualified as 3rd strikes but, again and again, DA's chose to let him out.
He has - among others - numerous DUI arrests that he was not imprisoned for. On the night of the dount robbery he was, by his own testimony, so drunk that he didn't realise he hadn't paid for the donuts. He had, nonetheless, driven to the store, and then drove home.
I hope he DOES do serious time... doing a couple of months at a time 3 or 4 times a year for 30 years just isn't having any effect. At least while he's inside he's not driving around drunk putting all our lives at risk.
