You definitely don't have a lawsuit, and she likely has a lawsuit against you. You don't have a right to be in the gym and they did not violate your civil rights by cutting up your card. On the other hand, you committed assault and could have been arrested.

Well, it wasn't the nicest thing to do. You could have just ignored her. The next gym you go to get some headphone and even if your not listening to anything prentend that you are and people will leave you alone. They shouldn't have banned you though it's not like you do this to everyone, and if it wasn't the instructors daughter I'm sure they wouldn't have cut up your card.

Um, you could be arrested for assault and battery - at least under California law, possibly even assault with a deadly weapon. If I were you, and let me tell you right now I am really glad I am not, I would count my blessings they are not pressing criminal or civil charges against you. Well i feal like it was not very polite to knock her over ,u may have hurt her badly. As for her mom ,i feal she was being protectove of her chiled,i don't think she should have cut your card.I hope next time u will be the adult and leave the situation.Have a good one.
