We leased a townhouse, through a management company, for two years and moved out at the end of the lease (1-31-09). The unit we rented is owned by a third party who was not on the lease.
During the weeks after we left I called the management co. several times to inquire about the status of the owner's inspection and the security deposit. The manager kept saying he was waiting for the owner to finish his estimates of damages and send them to him.
When I did not receive anything by the end of March I sent him a certified letter saying he had exceeded his 45 days (maximum time allowed in Maryland) and to send me my deposit plus interest. He responded on April 10 that we would not be receiving any of it back and that we were being charged more. In that letter he included the owner's estimates. The law says we can sue for 3 times deposit so we are taking them to small claims court.

If your lease is with the management company, you cannot sue the owner, since they are not a party.
On the other hand, the management company, as the professionals, are required to act in accordance to the law. If they exceeded the legislated limit of 45 days, it is their problem, you are entitled to your deposit. His problems with HIS client not supplying the documentation are irrelevant, the time was up. |
