What action can I take?
|
Hello,
So I was recently let go from summer employment at a local franchised coffee shop (won't use the name of the company). When it happened I was given no notice, and no reason, and I was informed by one of the shift manager's, who said they had no idea why I was being let go. I've only been working there about 3 months, and didn't plan on working there past september anyway, as I'm a student.
The kicker is this; I phoned the store owner to ask him why I was being let go, and he refused to speak with me. I went in person this morning, and he had no choice but to sit down and answer my questions. The only reason he could give me as to why I was being let go, was because he didn't know that I was dating another one of the employees (who I should add, was also fired the same day as me, in the same manner). I had only worked with her two, maybe 3 times, and in no way did I ever bring our relationship to work. In fact neither of us ever told anyone, they found out from one of the customers. On top of all this, the store owner has never even worked a shift with me.
What should I do? Should I email the company's headquarters? File a complaint somehow? This isn't allowed is it? It was my belief that in a civilian job, you can date anyone you please so long as it doesn't effect your performance or integrity at work.
I should also add that there have been at least 2 other "couples" who worked there, neither of whom were fired for it.

Most states are "right to work" states. That means that either you or the employer can terminate the employment "at will" and at any time for any or no reason. You can walk out without giving notice and the employer can terminate you without giving notice.
That said, the termination cannot be based on discrimination. If they fire all the people who date, then you don't really have any recourse. Of course you can write the headquarters office but it will probably not do any good. And most places of employment use a 90-day period during which they can let you go without notice anyhow because it is a training period.
So legally, you could get an employment attorney to look at the case. The attorney will give you one free consultation and decide if you have a case or not. If you have a very strong case for a lawsuit, the attorney might take the case for a (big) percent of what you would win from the company. If you have a weak case (which you really do), then the attorney may still sue the company but you would have to pay the attorney yourself several thousand dollars and "hope" you win. |

If you work in an at will state you can be let go for any reason and at any time. Nor are they required to give you notice that they are going to fire you. If the company policy says no dating then no dating. You could file a complaint with company headquarters but I doubt anything will come of it. |
