Hearsay is an out of court statement offered to prove the matter asserted,.
Here are three examples of statements that are not considered hearsay:
1. An out of court statement by a party in the case in question. (Defendant driver says at the scene of the collision, "Sorry, this accident was my fault, I was talking on my cell phone and didn't notice the red light.")
2. An out of court statement by a witness on the stand. (In trial against black man where witness identifies defendant as the bank robber, evidence that the witness earlier described robber as a white man to her friend).
3. An out of court statement not offered to prove the truth of the matter asserted. (Someone announcing that he is God-- the statement is offered to prove that the person is delusional, not offered to prove that the person actually is God.) |

- excited utterances
- present sense impressions
