What are laws regarding a 16 year old American coming to UK?
|
Is it possible for a 16 year old American girl to come over here to UK (Scotland) to live with my family (self, husband, 2 kids) and study here?
I understand the legal age for leaving home is 16 in UK but 18 in US.
Would UK law apply once she is here? Meaning she can live here with us? Would she need parental permission from her own parents?
This may be tricky as basically it is to help her out of a bad situation at home.
Any advice is very much appreciated. :o)

She remains a minor under US law, and, as someone has already pointed out would need a visa. However it's highly unlikely a residency visa would be allowed, and she would come over on a student visa which would last for a maximum one year (renewable, but she would have to return to the USA. The child is, and would remain a US citizen (and thus subject to US law) so the big thing would be parental permission. That would most definitely be required, otherwise there would be the possibility that a charge of kidnapping could be brought against you and your husband, should the US parents oppose the action.....? |

She would need a Visa to visit the UK and live. In order to get a Visa she would need parental consent as she can not apply her self until 18. |

Once over here she can do anything (pretty much) that a UK citizen can do. She will need a study visa to move here and the rules about work etc will be part of the visa. As she is on a study visa, much like I intend to do in the future, she may apply for permenant residence before her visa runs out. The problem is however that she will most likely need parental permission to apply for this visa.
As you said there is a bad situation at home, if she cannot get permission she could always file for emancipation.. |
