I have lived at this place for close to four years with no problems. But this newyear, when I came back from a one week vacation, my landlord was waiting for me in the living room.
He told me that a few days back I brought someone into the house who stole a needlepoint picture of his wall.
I told him that that isn't possible because I was in Florida. But he insisted that it was my friend. After a bit of quizzing, I realized that he had only heard two people enter the house and one of them call out "I'll wait for you downstairs" -- and from that he concluded that it was me.
I asked him to report it to the police, and told him to contact the police. I didn't hear anything about it for a while, but last week he started again. This time he is insisting that I return the picture or he will file a lawsuit against me. Moreover, his story has changed; now he’s saying that he actually saw me enter the house with someone.
Background: I am a PHD student, and all of my friends are research assistants with generous stipends and NSF grants. My landlord is 60+ and often brings bums into the house to help him with chores.
My question: can he file a credible lawsuit against me? Could I end up having to pay him? Will the fact that he is a US citizen and I am not, sway judgment against me? Will moving out make me look guilty?

if you were out of town he hasn't got a chance, tell him to call the police if something was stolen out of his apartment. If he still tries to sue you, countersue for your legal expenses |

It sounds like this guys a little coo coo. I would check your rights for your state and keep proof of your trip (i.e plane ticket, hotel confirm, car rental forms, movie stubs, etc ) just in case so you can prove you were out of town when he thought you took it. I would just let it go, im not sure if moving would be the best thing to do but at the same time i wouldnt wanna live with a crazy either lol. Good Luck! |

I would suggest you pick up a tenant rights handbook for your state, so you are knowledgable on what he can and can't do to you.
It seems to me that he has no case. |

Go to the police department and file a report. Tell them what happened.
Also keep receipts and anything that proves you were away in FL. |
