The law requires you obtain appropriate legal documentation but does not require you to be an expert in document validity. If it looks real to you you are supposed to accept it, because it is discriminatory to refuse to hire someone due to their immigrant status if it is "lawful" for them to work.

If you know they are false documents however, you must report that or discharge them. Since you are NOT an expert in documents, I would say to call CIS and report the suspected documents and document that you made the call, and then it's not in your hands any longer.

YA is a sham

Since you are aware of the situation, you are now legally bound to take action. The employees face charges of using falsified identification besides whatever crime they are covering up by doing so. You now are an accomplice and face felony charges for harboring fugitives if they are on the lam or your business can be confiscated by the INS if they are illegal immigrants. With all the recent bbudget cuts for various agencies across the nation, some legal office will surely take advantage of their legal right of confiscation.

Rest assured, such an issue can break you financially.

If you know they are using fake ID - you should fire them. As an employer you are required to check each employee's ID. If you know it is fake ID and you do nothing - you are as guilty as they are.

The change in law was, who was responsible for knowing the social security numbers. The way law was written, there was a question as to who would be liable, if the employee used invalid SSN. Was the employer responsible for verification?

Since you now KNOW about their status and SSN being invalid, you are now knowingly employing illegal aliens. The change in law has no bearing in your case, since you already know.

ahh my favorite. my parents used to own a restaurant a mexican one. they had some illegal immigrants working there. if they are caught you can get charged and they my be deported. now they never found out my parents were doing this but soon the resturant closed due to $6,000 rent per month. good luck man
