I was baby shower shopping for MY baby shower of all things, with my mother, when my ex landlord who i am in a landlord tenant dispute with, took my picture WITHOUT my permission, with her phone! You see i had had a court date on April the 14th and i requested a postponement because i am pregnant and have 101 things that are stressing me out at the moment and the last thing i need is to worry about a court date! I made this very clear to the judge and he granted the postponement. Some how my landlord got the idea i requested the postponement because i was on bed rest (which i NEVER even suggested) and she came up to me at my own job (off the clock of course) while i was shopping and while i was looking down at the checklist of things I heard someone say "katie i thought you were on bed rest??" when i looked up, without my permission she snapped my picture with her camera phone. This of course INFURIATES me and i wish to push it to the fullest extent whether this be a lawsuit or what be i don't care i believe it to be very wrong! Anyways i went to security in Walmart and told them the situation, they gladly escorted me the rest of the way threw my shopping and kept their eyes on her. The head of security told me that the whole time that she was in there she was following me around the store and keeping her eye on me. So today i am filing a restraining order on the terms that she was stalking me. I plan to counter sue one for harrassment, two for stalking and three for pain and suffering, with the amount of stress she has put on me it could have very well made me go into pre-term labor, risking my childs life. You see also i am the one who dealt with her this whole process never has my husband because well i have the courage to stand up to this woman and she has singled me out and has made SEVERAL personal attacks and i just wonder exactly what i could push in court. Opinions and suggestions are GREATLY appreciated. Oh and by the way i am located in Bates/Cass county Missouri. Thankyou

There are no laws about taking someones picture in public. In the privacy of your own home is a different story but we are talking about public places here. The laws comes into affect when the accused party is using your picture without your consent for financial gain. Lets take for example a public place like walmart, have you seen the security cameras there, so in actual fact your picture is being taken all of the time. If your picture is taken in the privacy of your own property then there are certain laws to deal with that but when you are out and about in public places it is a free for all. Sorry |

I think yOU have every right to proceed with it, she has no right to follow you around like a maniac, you don't know what she is caapble of doing, if you feel your life is a threat especially in your case being pregnant I would definitely follow through with setting standards for your security of yourself and especially for the baby. Who would go that far to follow someone around anyway that simply states craziness to me. |
