I want to appoint a very dear and trust worthy long time friend to be my son's god father. But I want to take it to the next level I want to ensure that in case something happens to my husband and I that he is the one that will have all rights to have custody/ guardianship of my son.
What forms do I need so create and have him sign? Do I have to go thru a lawyer? Should I also include this in my will?

I was told you can just write up a note and have it notarized with this Information on it. We did this for my Grandson who has just recently turned 18 making it void.
We just write I (your name)( this would have to be names of both parents) request that my child (his name and birth date) be placed in the custody of (name of person you want) If I (we) are ever unable to care for said child at any time prior to his 18th birthday . signed by both dated and registered with a notary. Thank God we never had to use it but it gave us peace of mind as she was a single parent and him being conceived in violence. Keep a copy with your important papers and give one to the person you want to take control yes you can add one to the will also |

The best thing to do is have a will prepared by a lawyer which names a close friend or relative as guardian of the person of your will. Also consider who will be the financial guardian of any funds your child will receive by inheritance or from the proceeds of insurance, etc. |

Your WILL is the document to do that.
States have different laws regarding holographic wills (that's what they're called).
It's best to go through a lawyer.
It may cost a bit, but the peace of mind is worth it.
By the way, a god parent is a RELIGIOUS position.
The law does not recognize it and does not consider a god parent when deciding a child's guardian.
If you want this person to be the guardian, then put it in writing in BOTH of your wills. |
