What are the legal stipulations regarding Brass Knuckles?
|
I suspect each state has different legal stipulations regarding brass knuckles?
What if you get pulled over by a cop for something and they find brass knuckes in your car or on your person?
What if you punch someone with brass knuckles and get prosecuted---how does the fact that you had knuckles come into play per your punishment/sentencing vs a bare handed assault?
I think cops, attorneys or judges would be the ideal respondents here--or someone who was busted in the past per something to do with knuckles?
Thanks!

As brass knuckles are legal in some states. there is a catch 22 that is if they cant be seen they are considered a concealed weapon in most of the country. however most law enforcement officers will usually give you the option to give them up or go to jail
If you were to strike someone with these it would be considered assault with a deadly weapon which is far worse than just using your hands
So with this being said It is better to carry a ball-peen hammer that is totally legal and easier to use. |

In most places they will be considered an illegal weapon so to simply possess them can be a criminal offense and depending on the local police you could well be charged with both the illegal weapons charge and a concealed weapons charge.
Yes if charged with using them it can indeed alter charges, Given that you can break bones with them it would not be hard to imagine a simple assault charge becoming assault with a deadly weapon - more commonly referred to as aggravated assault the aggravating factor being the weapon. |

In most states, brass knuckles are illegal weapons. Sure, you can buy them on the internet, but I wouldn't use them for anything other than a paper weight at home. You are permitted under Pennsylvania law to have one as a "curio" at home or to use it in a dramatic performance. 18 Pa. C. S. A. §908(b).
When police charge a person with a crime, they lump all possible offenses together in the criminal complaint.
Under Pennsylvania law, 18 Pa.C.S.A. § 908 (c), the possession of metal knuckles is a misdemeanor of the first degree. |

They are illegal in many states. Laws applicable to assaults with guns or other dangerous weapons would also generally come into play here. |
