The Second Amendment is basically taking powers from the federal government, rather than having specific rights. It is there to protect rights.
It does not protect the right to form militias, because the people do not have this right. They have the right to be in the milita, this is bearing arms. They have the right to keep weapons, the keep part.
The 2A exists in order to protect the militia, by giving individuals the protection needed to make the militia work. The militia needs weapons and personnel, nothing else is protected or needs to be protected.
The founding fathers made this clear, the supreme court has made this clear also.
The right to bear arms does not mean, the right to carry guns around with you, it does not mean all guns are protected. It means the US federal government cannot prevent individuals being able to get their hands on guns. So they can ban certain types and so on, as long as they do not artificially inflate prices and make it hard for individuals to get guns. |

It's the right to keep and bear arms. The debate is over whether this was meant to be and individual right, or the right of the states to be able to raise their own militia against threats, maybe even the federal government.
I don't want to get into a gun control thing here, but i do not think the founders meant for the people of this nation to be able to own, sell, and freely carry guns, without any form of regulation. I'm sure all the NRA members out there will disagree, and the fight will continue. |
