What can I do if my lawyer refuses to return my calls?

She is still on retain after my divorce but fails to return any of my calls. How do I request to remove her?

Most states require that family law attorney's return any unused monies. You may want to check with your local county or state bar office. They will also be who you will file a formal complaint against your attorney and will assign an arbitration hearing.

You will also need to file a "release of counsel," this term differs from state to state.

I would actually show up at the attorneys office prior to filing a formal complaint with the bar because their might be a reason as to why your calls are not being returned.

The bar could revoke the attorneys license to practice law, offer a refund in full, etc. Look in the phone book or Google to find your local bar association. Your state also will have one.

Good luck.....I hate family law attorneys.

First, get another lawyer, who will take care of notifying the court (and the other attorney) that you have new representation.

Next, make your lawyer's life a living hell by filing a bar complaint. Contact the bar association, write them a letter detailing your complaint. Lawyers hate bar complaints with a passion, they are torture to resolve and risk their license. You might also get some of your retainer back in the process, because they'll probably offer to "resolve" the complaint financially.

Chances are, if you fire this one and get another, they won't call you either.

I've never had any luck getting any lawyer to return calls. It must be like an unwritten rule.

If you hired her with a legally binded contract, you can hire another attorney and sue her!!!
