What can I expect for my first time in court for a DUI?

I'm in California and I was arrested for a borderline DUI. However, I am still waiting on the results of my blood test to see if I was under the legal limit. (My breathalyzer read .09 prior to the blood test)
I haven't hired a lawyer but I was wondering once I attend court and get my results if I could request an extension to acquire further legal advice. Meaning, can I ask the judge for another court date so that I can hire a lawyer? And what exactly do I say?
Any other info you may have on this subject would be helpful, thanks!

It doesn't take a genius to tell me I'm gonna pay a fine and have my license suspended. I have also had friends killed by drunk drivers so no, I don't need to be lectured on the dangers of it! FYI: I was obeying all traffic laws when I was pulled over, I'm simply asking for legal advice. If you're not able to give that then please don't bother answering.

Yes, keep your court date and ask the judge for an extension to give you the opportunity to seek council.
Your other option is to plead not guilty and the judge will then set a court date for trial. In the meantime you can seek council. You will have the option of changing your plea later at the time of trial.
The law/penalties are quite specific regarding DUI charges in California. There are mandatory penalties you will most likely incur with or without an attorney.

Do NOT go to court without an attorney. Period. I know it's expensive, but you will regret not having legal help from the beginning of this process. Judges generally are at their own discretion, but many of them will not be tolerant and give you extra time to hire an attorney, when you should have had one hired before you came to court the first time. They do NOT like having their time wasted, and things will not go well for you if you're the one slowing down the system. Hope this works out ok, and hope you've learned a valuable (and expensive) lesson. Best to you. |

First of all you should not drive while drinking at all i don't care if its just a beer. How would you feel knowing your kid is out driving while somebody out there is drinking and driving and then that driver ends up killing your son in a car crash??? You need to think before you do this again!!
Now to answer your question most likely you will pay a big fine and you will get your driver license suspended. |
