What could you expect to get sentenced for affray, GBH and I think common assault.?

My brother was attacked at on Monday. His girlfriends insane ex boyfriend pulled his arms through a smashed window. My brother did not provoke him and the lad is known to the police. He has only just come out of hospital today (Thur) after having surgery on a huge gash in his right arm. The lad who did it has been arrested and is currently being held in custody. The police have told my brother that if he is charged then it will be with GBH (with intent I think) and affray and also charged with common assault on my brothers friend. My brother will be out of work for at least 3 months and will only get statuary sick pay so we're hoping for a fair amount of compensation.
What are the max sentences for the above? And what can we actually expect him to get? And then what can we expect he will actually serve? Also how much could he expect in compensation? Or how is compensation calculated?

GBH with intent (s18, Offences Against the Person Act 1861) carries a maximum sentence of life.
Since he was provoked and is known to the police the sentence will be higher. It also depends on the extent of the injuries. With affray also, that will add extra time.
The most usual sentences are between 2 and 5 years. Sentences below 2 years and above 7 years are rare. Given what you've said (unprovoked, previously known, additional offence of affray) there is really no way he'd get below two years.
He's looking at at least a 2 year sentence. |
