What do judges look at in a custody battle?

I live in the state of texas. Me and my ex have a 4 year old son. I left his father 2 years ago and never took him to court. Ever since then we both have been sharing time with him. We have set a schedule so that he gets him half the week and i get him the other half so that it is equal. Now that our son has just turned 4 he is about to start school we need to establish where he is going to go to school. I want to take him to court before school starts. He dosent pay me anything at all. He wont help with day care so that i can work. I do not have a job right now but my finacee is paying the bills and taking care of us at the moment and we have our own place. What i want to know is how do i get custody of my son?

In Canada, judges consider the "tender years doctrine" when deciding with whom the child will reside. The doctrine says that children tend to thrive better when left with the mother until they are at least seven years of age. Judges in the U.S. are trained in the same interpretations of law, so it's likely the judge would award custody to you and order his father to pay support.

unless you have something very wrong in your life the son will live with you

They very rarely award custody to the father over the mother unless the childs welfare would be jeopardized by staying with the mother
