they are not criminals. they are refused asylum seekers. There is a subtle legal difference. one is a convicted criminal the other is a perosn who was fleeing persecution in his own country but who failed to convince the Border & Immigration Agency of the validity of his claim. This does not mean that his claim was invalid, it merely means that he failed to establish his case. The second person has not committed any offences and is not a threat to public safety.
