I was assaulted by an american citizen in a foreign country .The guy fled the country same night .A warrant for his arrest at that country was issued. Now I'm back after suffering from 3 broken ribs ,shoulder and from kicking me on the mouth and head ,broken teeth.this is a typical hate crime.Hate crimes are not always deadly.

it is a hate crime because he is revenging from my husband through me .He was'nt satisfied in pushing down 12 concrete steps he followed me down and kicked me hard on the face,all over my head ,stopped when he saw somebody coming.Fled the country while I was being taken to the hospital.Yes I'm an american citizen too.I did file a law suit against him in his state,but now the court is saying upon his attorney's answers to my suit that this should be under the laws of the country the assault occured ,and the court calls it choice of law.The same law he fled from.And by the way this person is a doctor in one of the best hospitals in the states.And also he has a violent past, not known in America because it happened in one of Australia's airports.I still did'nt give up but I'm afraid my lawyer will because now the court is asking for information about the law where the assault took place,even though this doctor fled the place and he'll never go back.He will get away with it .

I'm assuming you are also American. You can sue him in American courts, even though the assault occurred in another country, as long as you know his name and where to find him.
EDIT: jsmack19 is incorrect. There's a difference between jurisdiction and choice of law. American courts will always have jurisdiction over disputes between two American citizens, even if the events causing the dispute occurred in another country. Choice of law is just the specific laws that must be applied by the court in a given case, which can be difference from the laws of the jurisdiction where the court is situated. Your attorney is the one best suited to address this argument. |
