If you are not familiar with the case basically a 13 yr old honor student who had no record of problems of any kind was strip searched by her public school in Arizona after another student claimed that the girl was giving out prescription strength ibuprofen pills.
The parent was not contact for consent or asked to come to school.
The girl gave consent for school to conduct a search and no evidence had been found which is when she was sent to nurse for the strip search.
The school's case is that they had reasonable grounds for such search because another student told the Vice-Principal that the girl in question was giving out pills and brought one in and gave it to the school the next day.
Now, I usually say if school has grounds they have the right to search kids, etc as they have to protect everyone else's kids as well as employees and such.....but I think the school conducting a strip search of a 13 yr old was way too far based on all the information. There was no record to support this, it was based all on the evidence supplied by one person with nothing to corroberate, the girl agreed to search and nothing was found......at what point does an adult in this situation think "Well better have someone check her naughty bits to be sure" instead of "Well we have nothing so I am calling the mother and asking for a meeting".

The entire episode is completely ridiculous. Even prescription strength ibuprofin, isn't all that dangerous. I take it for knee and back problems all the time. It is the equivalent to about 3 standard Advil tablets.
How dumb have we become to strip search children for these kinds of meds? Especially considering that you cannot get "high" from ibuprofin.
All the more reason to home school your children.

I'll tell you, if I could go back to my first year in high school I would have started immediately on a GED and even before High School.

The school stands in place of the parent and should have the authority to search the girl, as you describe.
However, this particular search seems unwarranted and the Vice Principal may have used poor judgment. That would seem to me to be a disciplinary situation controlled by the Principal and the School Board, not the court system. If a kid was giving drugs to my kid I'd want him/her searched. But, we need more evidence than "she did it." |

Does this mean that anyone in the school can accuse another resulting in a mandatory strip search...no warrant...reasonable cause?
If the strip search is not mandatory, on what basis are some students stripped and others not. If a teacher was accused, would they also be strip searched or do they have more rights?
Does a 13 year old who is not considered legally competent to make their own decisions and requires an adult guardian, able to consent to a strip search.
My hope is that she is able to sue the school for a great deal of money. Just in case, she could put some aside for therapy if needed.
Who ever made this decision should be fired. Even better, on there way out of the school they should undergo a full cavity search just in case they are trying to steal any erasers. |

NO school has the right to go any farther than to search the locker or book bag!!! a school is not law enforcement. even the police wouldn't have done that search without the child's parents there!!! that school went WAY over the line!!! they should have called her parents, then called the police, and THEN had the police (a female officer) perform the strip search in front of the parents (lets ignore the fact that the school KNEW it was for aspirin) if I were that girls parents I would have yanked her out of the school and slapped them with a law suit so fast it'd make their heads spin. |
