are you going to get arrested because you want proof that toyota was going to pick it up, and agrees to but and refuses to get the car towed because they are not from toyota?

In most states, it is a civil issue, unless the courts have given them an order of repossession.
Without the court order, it is not going to land you in jail.
Toyota themselves are not going to come get the car, they contract with a recovery/repossession company to get the cars, then pay them a set amount.
If the court gives an order of repossession, and you refuse to turn over the car/property, then yes, you can be held criminally liable.
Toyota won't just arbitrarily send a wrecker company out to pick up a car, if the person has been behind, or hasn't made a payment in some time, then it is reasonable to expect the car to be repossessed.
It will be repossessed, I assure you, either at home, at work or at the grocery store, the car will get repossessed. |

OK, basically it sounds like you defaulted on your loan and you were going to just give it back to Toyota but a repo man came and got the car?
Basically, your car was reposed. Involuntary means you did not give up the car on your own accord, they took it. No car dealer will voluntarily take back a car, they may tell you that but they actually have a repossession company come and get it and then auction it off for the difference of the loan and you will owe whats left if it did not sell for much at auction. Sounds like they already had someone coming for the car and if the payments where 3 months or more behind they automatically have a repo company come and get it....just wait until you get the after auction papers or catch up on the loan if you want the car back. Then you can either haggle with them to lower the amount or get your car back....don't worry so much, involuntary or voluntary it still screws your credit just the same....sorry to hear that happened....Good Luck |
