I am going to court soon because a friend of mine does not want to pay me my money back. Honestly I don't even want the full amount of what I loaned them I just want their stuff instead like their flat screen and computer. That's something personal and they use on an everyday basis. Anyway I have a copy of a promissory note that was notarized by the bank, credit card statements showing cash advances, as well as deposit receipts to show that the cash advances went into my friend's account. What other evidence do I need to make a good case?

What you have is perfect to take in and should win your case. But I wouldn't even mention not wanting the full amount of what you loaned them, the judge can't award you something that already belongs to them. |

it appears from your statement above that you've covered all your bases except one.
you don't say how long your friend has owed you the money, and what attempts you've made to attempt to collect your debt. you need to check withe court you filed in t make sure the statute of limitations has not run out. in certain instances your are barred from collecting on a debt if you have not filled your lawsuit in a timely manner or if you have made no attempt to collect the debt for a certain period of time.
since you don't state which state you live in i can't be more specific.
also, it's the court option whether or not to award you your friends personal items. you would have to prove that the funds loaned went to purchase those items if they fall in your states personal exemption category, based on it's primary use. |

If you tell them what you said above about wanting their personal stuff they won't take you serious...but the items you've mentioned above sounds like a good start...the more you have on paper and proof of what they did you should do well...get all your money back and buy your own "stuff"...good luck! |

First off.. you will not get their stuff, i.e the flat screen and computer. If the proof is there, which it sounds like you have (cannot think of anything else you need, seems right to me) then an order will be made for the amount to be paid to you, either in lump sum or by way of installments. If they breach a payment plan through the Court, then it can be ordered that their goods and possessions be sold to recoup the money. I know you are peeved with them, but do not repeat what you said here (about not wanting the money, wanting to make it personal) as it does not look good, looks vindictive and Courts take a dim view of that sort of thing, its irrelevent to them what you want, it is what the law requires... sorry, not meaning to sound harsh, just something you should know.. |

You need to bling the truth with you and the evidence to back up the stories or defend the counter-claims which it sounds like you have, a witness never hurts either. But most importantly stick with the truth and don't embellish it to impress the court. And be polite. |

Having the notarized promissory note is primo.
The other receipts and stuff is necessary, also. Bring any witnesses who saw you give money over, who witnessed use of the credit cards, who can testify factually that you gave the friend money.
All the friend has to offer is "no, he didn't!", so you need to be very clear that "yes, you did".
