What exactly gives the gov. the right to make a drug illegal?

It seems like it would be infringing on our civil rights.They're basically telling us what we can and cant put into our bodies. I'm not saying I think it's wrong. I'm all for drugs being illegal, but what exactly is the government's reasoning behind the drug laws. What makes it okay?

Isnt it because posesion is what's illegal and not the act of taking the drug?

The federal government has the right to regulate interstate commerce. The states have the ability to legislate anything not granted to the federal government and not denied to the states. Therefore, the government can control access to substances. |

Read Article 1, Section 8 of the US Constitution. In it is a list of duties of the Congress. It includes "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes."
This phrase has been used to justify the federal government getting into all sorts of things it shouldn't be in.
It's a shame the 10th Amendment hasn't been enforced by the courts. "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
It's perfectly clear to me. Yet somehow the lawyers have screwed up both Article 1, Section 8 and the 10th Amendment to pervert the US government into doing all sorts of things it shouldn't be involved in.
Drug prohibition, social Security, Medicare, NEA, Dept. of Education. The federal government shouldn't be doing any of that stuff. |
