If he said he didn't have the radar turned on, then why would you want to see it?
You have the right to go to court and fight the ticket. The court will believe the cop 99% of the time.

i would plead not guilty and go to court. also asking a law enforment thats a family or friend for advice cant hurt, but there is no grounds to say you were going a speed. On the report it will say the method of tracking, but witnessed is not very trustworthy esspecially if he was moving in the other direction. |

first off you make it sound like he was moving..if this is the case he could not have accurately used a radar gun as they need to be stationary (held still)you can't have the radar gun moving and the vehicle your clocking moving it would give an inaccurate reading. whether they show it to you differs from state to state and sometimes just from local to state. i would fight the ticket as it must be stationary for it to give an accurate reading good luck
if he didn't have the gun on and was traveling the same direction as you he would use his speedometer to clock your speed.in this case have your speedometer checked by a professional and verified that it is correct and when he comes into court ask for the record of his vehicle.9 times out of 10 this isn't something most law enforcement officials carry but it is your right to request it to check the accuracy of his complaint if he can't provide this then the magistrate or judge whatever your area uses should find in your favor
sugar bear is wrong they will not throw out the ticket for you requesting the info on the radar gun it costs law enforcement nothing to get that record as it is done on a regular basis and barring it being dropped from about 7 feet not much affects the calibration of a radar gun so it won't help you |

and if you were paying attention to keeping to the correct speed, and you honestly were in the speed limit,

Does it say radar anywhere on the ticket? If it does, just pay the ticket.
If it doesn't, go to court and see if the police officer really did catch you on radar or if he was just "estimating" your speed or doesn't show up at all - which will get the ticket dismissed. |

it normally depends on what state you are in. but in places such as washington state, the cop legally has to show you the speed on the radar before he can give you a ticket. even though you may evade this, he/she could get you on reckless driving and other such things. another law in some states is that the radar gun has to be recalibrated every two months. to find out if the gun the cop was using had been recalibrated just visit your local police force and they will tell you the information on the radar gun and if it had been recalibrated in the last two months. if it hasn't been recalibrated in two months then they cannot give you a speeding ticket. :) |

A cop would not say anything like this...but if you want to dispute the ticket I advise you to do so only on the fact that the cop passed you and then slowed down to ticket you for speeding...do not feed the judge to much information...if your not a repeated offender your case may be dismissed !!! |

They have 3 methods of determining speeding, but he has to list one of the methods on the ticket when he issues it. Also, if he did cite radar as his method of determining speed, you can go to your municipal library and copy some legal forms that are requests for the maintenance records of the radar gun. Use them in your court proceeding and just see if they don't throw out the ticket just to avoid wasting the time and money it will take to get you those records and set a new court date. |
