What if you were approved initially but have your employer contest your benifits, do you pay it back?

I was approved for unemployment by the state that i live in, however now my former employer is contesting that decision because they disagree with the state's reasoning. If it is not found on my behalf, do I end up paying back what was already given to me? How can the state award you something and then make you pay it back?

If the Unemployment Office finds in favor of your employer, yes you have to pay the benefits back. Why? You weren't eligible to receive them in the first place. They are not just going to let you keep money to which you were not entitled.

Every claim for unemployment is checked with the employer. There are conditions you must meet to receive the benefits. You should take a look at the eligibility requirements for unemployment in your State, and see if you can figure out why your previous employer is contesting your eligibility.

I wouldn't worry.

Once the State decide to award Unemployment Insurance , it is highly unlikely that they will change their mind because the employer doesn't like it.

What does the employer care anyway.?

He has been paying your unemployment premiums. He won't get that back.

I've never heard of such a thing.

It would be worth spending a bit of that $ to get a lawyer's opinion.

I'm not a lawyer, but I think that if you did not influence the original decision by misstatements, you need not make repayments. You would have had every reason to think that the benefits were yours to do with as you wished. The legal term "estoppel" comes to mind.
