What is a post nuptual?

we are in the process of divorce. but have decided to give it another shot. Now he is asking for a post nuptual

A Postnuptial Agreement (sometimes referred to as an After Marriage Agreement or Post Nuptial contract) is a written document signed by parties to a marriage that sets out how they agree to have property divided, spousal support determined, and attorneys fees paid in the future if the marriage ends in divorce.

A post nuptial agreement?

He is asking you to reach an agreement/form a contract regarding division of property/assets, etc. before committing to a reconciliation.

A post nuptial agreement is a written contract between a couple already married.

AgriCult
he wants you to sign a form that assigns whose money is whose. Without this form, you would be entitled to half of his fortune.

A postnuptial agreement is a voluntary marriage contract between spouses that is created after their wedding.
It is important that each of you have your own legal counsel before signing a postnuptial agreement.

Basically it is the same thing as a prenuptial agreement, only after you have already gotten married. Basically it is a way for you to set a contract out to say how you would settle things if you ever did get a divorce. Since you have gotten close to getting divorced, I would proceed with extreme caution. You just never know if he is reconsidering the marriage so you sign this contract and then he turns around and divorces you anyway. Read it carefully with your lawyer so you get the full understanding of what it all means before signing. It will determine how much of the jointly held assets are divided and possible whether you get any money for alimony or what child custody (should it pertain) will be should you divorce. It can also put in stipulations such as that should the marriage be ended by you or by an action of yours (such as unfaithfulness) you would get less than if he leaves you or the marriage ends agreeably.
These kinds of contracts can be very good so you know if you both want to walk away from the marriage, the details for the divorce have already been determined. It keeps from drawing out divorce proceedings and causing disputes and things getting nasty. That can be helpful. He may want to get you to sign it so if things don't work out, you have everything ready and won't have to go through so much later. As long as you both are happy with the agreement and can live with the arrangement, it can be a good thing for both of you.

A "prenuptial" agreement that you enter into after you are already married.

Watch out, he may be trying to trick you into signing away things and planning to divorce you anyway after you do.

It is a pre-nup, only signed after the wedding.

Get some advice from an attorney!

It's functionally the same as a pre-nuptial agreement, except the post-nuptial is entered into after marriage. It outlines your affairs and assets and any other agreements in the event of separation/divorce.
