If the victim and 'rapist' are both under the age of 12 is it still considered rape, from a legal stand point? By definition, what I am thinking of WAS rape, but what happens to the kids if they are underage. Is it still a crime?

yes it is rape of course laws are different from state to state depends on the nature of the rape what punishment will granted to the child in some states even the parents can also be held accountable in a case like this i am sure that the victim is to young to understand all the emotions that goes along with it please have her to seek professional help counseling would be of value i would suggest that this be reported as soon as possible it is hard to prove rape without proof and i know that someone this young might also worry about the raper since he is so young let the authorities handle it the victim isn't responsible when he raped her he was the one in the wrong even if he is a child if it goes unreported he will most likely keep on doing this to others and eventually one of them will report it and if he is older then the punishment will be far worse if she reports it now it might save others from going through this and also might stop him from doing this again i would also think they will offer / demand that he gets some help like counseling or some type of reform actions please report it regardless of what happens its his own fault not the victims. good luck and act on this now |

Yes it is still a crime but it would be in a juvenile court and he will probably have it follow him through life. If this has happened to your or your kid or whoever report it right away. |
