If a "daddy" sat around and watched his daughter's teeth rot right on out of her mouth, how many years later can he be prosecuted? He never showed her a toothbrush. When she lost a tooth at 16, he smiled and said, "Oh, now you'll get a visit from the tooth fairy." I know he also molested her, but that's a separate issues, one SHE needs to deal with. She is now 26. Is it too late to file charges?

Both of these issues are issues SHE needs to deal with.
As far as the tooth decay, this is almost a non-issue at this point compared to molestation. One reason alone is the fact that tooth decay can occur for many reasons...not enough money for regular dental care, poor diet, poor dental hygiene habits, genetics, etc. It would be next to impossible to prove this was a deliberate act of neglect on the part of the father.
Much more important is the issue of molestation and related statutes. If anyone is hell bent on pressing charges, this should be the topic for discussion, and rightfully so. This young woman should focus on counseling and moving on with her life in general. Repairing her soul is more important than her teeth at this point in time.

It seems that this may fall under the catagory of 'general neglect', as opposed to severe neglect. I havent found a statute of limitations for Ca, but the link I provided may lead you in the right direction. Im sorry, but by the sound of it, Allowing the childs' teeth to decay and rot may not be something that can be prosecuted. He can simply claim she refused to brush her teeth. |
