What rights do we have...car repossessions?

I would think they can't go into your garage as that would be trespassing. And unfortunately they can call family as long as they identify themselves right away I think. They're putting the squeeze on you and trying to humiliate you into getting in touch with them. They only way to make them stop calling other people is to not ignore them and get in touch with them. Even if you're just letting them know you can't pay now but tell them when you can pay. Or pay them some of the money you owe and set up payments for the rest. They won't stop until you take responsibilty. Sorry, but that's the way it works.

If you pay your bills you don't have to worry about it. Deadbeats costs banks a lot of money and drive up interest rates for the rest of us.

Just pay your car payment and you won't have that problem. They can legally take your car if you are not making payments. They can call family members too. If you file bankruptcy that can stop creditors from calling but you will probably lose the car anyway.

It's funny.... There is nothing they can do if they cant find it? Possession in 9 tenths of the law. This is why they steal it in the night. I think it has something to do with contract agreements btween two parties and its easier for them to find it and sell it then take you to court plus they have to find you first. I once had a car for 2 years without being found because they would not take my payments to catch it up, and the company "Americredit" had wrote it off, but still wanted to collect the car and charge me for the full unpaid balance even after it would be sold. They cant take it out your garage, but they can block until you call the police, they also have to have a warrent this is why they try to attemidate you and steal it in the night. They can take it wherever they see it. ***Dont apply for credit using your current addresses or location, don't apply for anything new, no utilities, no new phone, no nothing, use different addresses like a mail box R- Us company, where you can use the address as a suite number. US postal wont allow this, but private mailing venders will. Dont use your personal information on the internet, classmates.com or any of that junk until you pay it all up or decide to give it back because you have other arrangements. I had nothing in my name I had moved to another state and was going back home to renew my tags every year. I never would register that car in the new state! They could not do searches for me I had no mail sent to the house I lived in. Its was like I still lived where I had, but vanished into thin air, no history to track me other then what they knew and could not follow. I never hid the car not one time either. Also they can unblock blocked phone numbers when you call them back so don't call back from a land line or cell number in your name, they will track you straight to wherever you are. I tested this when I called them from a friends house blocked and they harrassed the hell out of her! She got them off her back by telling them she had guest over and I may have been one who asked to use the phone, but she did not know me that well and I came with someone and they stop calling her! When I called the repo man to pick it up 2 years later. He was so impressed he asked me how did I do it. He was a private investigator and said he was the best and I had him stumped, of cource I never told! LOL! This may sound extream, but the thing to remember is everyone is trying to profit of your demise. Everyone is getting a cut from "me/you/us/we the people", for having a rough time in our lives! I refused to let them win when I have tried to do better and they wont allow me to. The only one who was going to hurt from that car being picked up was me or in this case you. They all are still going to get paid one way or another and they use collection agencies and others to scam you for your misfortune. Leaches!!!!

Well technically, its really not your car until its completely paid for and it seems that your having trouble with that part. If your garage is locked they cannot get it because its breaking and entering. That doesnt mean they wont, just means theyre not supposed to. Repo people get away with alot because people think that because they were behind in paying, the police wont help. Wrong! If you leave your car unattended anywhere (church, store, street, etc) a repo man will take it.

As long as the information they are using to collect doesnt include your social security number, this is all information that you submitted when getting the loan from the bank. As long as this info is used in good faith to attempt to collect a debt and not to slander you maliciously, its legal.

Bottom line, pay for your car or they will take it. You signed a contract be responsible and pay for it or legally it is theirs. Sorry, I know that you don't want to hear this but the truth hurts.

They can take the car wherever and whenever they please - it does not belong to you.

they can take your car while at church or the store but they cannot take it out of your garage. They cannot harass you on the phone before or after business hours but they are not allowed to make physical threats. As far as calling family members I am not sure but I am sure that would be legal as long as they are not making threats of physical harm.

They cannot come into your garage. They can take it if it's in a public parking. Church and store parking lots are fare game.
Good luck with the BBB. They will assume you are a deadbeat who can't keep up with a car payment.

The harassment is illegal, but the repo isn't.

They cannot break into your housing structure, but if the door is open, they can move it so that it may be taken. They can pretty much take the car at anytime. The best thing to do is call the finance company, make a deal or turn it in yourself. Pretty much if you default on a loan, you don't have a leg to stand on. Speak with a lawyer or a legal referral site to get some advice.

You owe them money or the car so they have a right to do that ...... yes.

As for taking it out of the garage I don't know about that. But I do know they can take it if it is out in the open.

They can only hold it for 30 days though before selling it. (ga law anyway) You have 30 days to bring current or to pay off.

And repo companies are not bound by FDCPA (fair debt collection practices act) it is only collection agencies.

At the point that a car is being repossessed it is no longer your car, it is the leinholders, and they can pretty much do anything to get their car back.

If your garage door is open, yes.

Yes, they can take your car while you're shopping or in church.

Yes, you can file a complaint with the BBB about the messages and harassment of family members.

Of course, if you'd made your car payments on time you wouldn't have this problem. Have you tried calling the bank and working something out? The banks only repossess as a last resort....give them a call and see what happens.

They cannot take the car out of your garage. They can take i from the grocery store and church or any other place it is parked. They should not be leaving calls with your info at anyone's. Legally, they can say they need to speak to you about a personal business matter, but may not legally give out any more info that that. I do believe you can go to jail for auto theft if you "hide" the car.

Varies by state; but it doesn't sound like they've done anything illegal to recover THEIR car that you refuse to pay for or return.

Only "iffy" thing there is if what you consider "harassing" and "Personal" information on cards; but you'd need an atty to file a Fair Credit Reporting Act Violation against the lender; and I'm not even sure if repo companies are bound by those laws.

My cousin is a sheriff and he told me that if you tell them when they come to repossess your car that they can't, then they really can not do so unless they have a court order. I'm sure you can get them in big trouble for harassing your family and such as well. I would talk to a lawyer or an officer from a different area to see what they think about the matter.
